CITY OF NORTH OLMSTED ORDINANCE NO. 99-146 BY: MAYOR MUSIAL AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF NORTH OLMSTED TO NEGOTIATE AND ENTER INTO AN AGREEMENT WITH THE CITY OF NORTH RIDGEVILLE, OHIO, CONCERNING PROPOSED CYPRESS AVENUE, AND DECLARING AN EMERGENCY. WHEREAS, a retail development is proposed for development in North Ridgeville on the north side of Lorain Road near the North Ridgeville boundary with the City of North Olmsted; and WHEREAS, the City of North Ridgeville desires to reconfigure a portion of proposed Cypress Avenue in the said proposed development so that the terminus of road at Lorain Road will not interfere with nearby freeway entrances; and WHEREAS, said proposed re-configuration would require that a portion of said Cypress Avenue be located in the City of North Ulmsted and that said portion have a terminus on Lorain Road in North Olmsted; and WHEREAS, the City of North Ridgeville is willing to assume all of the construction, maintenance, and repair obligations for the said portion of Cypress Avenue to be located in North Olmsted, and further to indemnify and hold harmless the City of North Olmsted from any and all claims for liability for injury or damage which might in the future arise from the construction, maintenance or repair of said road; and WHEREAS, it is the desire of this Council to co-operate with the City of North Ridgeville in this matter and to accordingly authorize the Mayor to enter into an Agreement with the City of North Ridgeville which would bind the City of North Ridgeville to certain construction, maintenance, and repair obligations in the event that this Council ultimately accepts dedication of that portion of Cypress Avenue to be located in North Olmsted; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO:
