??. <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 99-75 <br />BY: COUNCILMAN MICFIAEL GAREAU, JR <br />AN ORDINANCE CREATING NEW SECTION 903.03 OF CHAPTER 903 OF THE <br />STREETS, UTILITIES AND PUBLIC SERVICES CODE, ENTITLED "SIDEWALKS, "TO <br />REQUIRE THE CONSTRUCTION OR RECONSTRUCTION OF SIDEWALKS IN THE <br />PUBLIC RIGHT-OF-WAY ABI/TTING COMMERCIAL PROPER7Y IN THE CITY OF <br />NORTH OLMSTED WHICH IS IN THE PROCESS OF DEVELOPMENT OR <br />REDEVELOPMENT, AND DECLARING AN EMERGENCY. <br />WHEREAS, the construction of sidewalks throughout the City of North Olmsted enables <br />residents of and visitors to North Olmsted to walk to any part of the City and thereby furthers the <br />public healthy, safety and welfare of the community; and <br />WHEREAS, owners of single-family residentially zoned property have long been reyuired by <br />this City to construct sidewalks in the public right-of-way as a condition to receiving a building permit <br />to develop their property; and <br />WHEREAS, developers of commercial property in this City should, as a condition to <br />receiving the benefits of a city building permit, likewise be required, as a part of their development <br />of such property, to provide sidewalks in the portion of the public right-of-way which abuts their <br />property; and <br />WHEREAS, this Council accordingly desires to impose such a requirement upon all <br />developers of commercial property within the City of North Olmsted; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That there be, and hereby is, created new Section 903.03 of Chapter 903 of <br />the Streets, Utilities and Public Services Code, which, as created, sha11 read in its entirety as follows: <br />"903.03 CONSTRUCTION OF SIDEWALKS REQUIIZED. <br />Every owner of land who applies for and receives a building pernut pursuant to the provisions <br />of Chapter 1126 of the Zoning Code shall, prior to obtaining any occupancy permit to use said land, <br />construct, or if applicable reconstruct, a sidewalk along the entire right-of-way line of the said land <br />in accordance with the standards and other provisions of this Chapter." <br />SECTION 2: That all Ordinances or Resolutions, or parts of Ordinances or Resolutions, <br />in conflict or inconsistent with the provisions of this Ordinance be, and hereby are, to the extent <br />of any such conflict or inconsistency, repealed.
