, <br />_.-,%1 r,{,.Et,&-?_ <br />CITY OF NORTH OLMSTED <br />RESOLUTION NO 99-70 <br />BY.• COUNCILMAN DEAN MCKAY <br />A RESOLUTION DECLARING THE NECESSITY OF REPAIItING <br />AND REPLACING CERTAIN PUBLIC SIDEWALKS AT SUNDRY <br />LOCATIONS WITHIN THE CITY OF NORTH OLMSTED, AND <br />PROVIDING THAT ABUTTING PROPERTY OWNERS REPAIR <br />AND REPLACE THE SAME OR AUTHORIZE THE CITY TO <br />REPAIR AND REPLACE THE SAME, AND DECLARING AN <br />EMERGENCY. <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, <br />COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That it is necessary to repair and replace certain public sidewalks in <br />accordance with the plans and specifications therefor prepared by the City Engineer and <br />now on file in the office of the City Engineer. The City Engineer shall inspect the existing <br />public sidewalks in the City for the necessity of repair and replacement. The inspection <br />work shall be scheduled over a four-year period with the intent of inspecting all such <br />sidewalks in the City during the four-year period. Upon inspection of those sidewalks, the <br />City Engineer shall notify the owners of abutting property of the necessity of such repair <br />and replacement. <br />SECTION 2: That the owners of the lots and lands receiving notice from the City <br />Engineer shall repair and replace, in accordance with the plans and specifications now on <br />file, the sidewalks so described which abut on their respective properties within thirty (30) <br />days of receiving such notice unless the City Engineer grants an extension due to weather <br />conditions, or the owners may authorize the City of North Olmsted to repair and replace <br />said sidewalks and the cost thereof shall be invoiced to the abutting property owner at a <br />rate of the bid price received by the City in public bidding less $0.50 per square foot. <br />Other sidewalks not in violation of City ordinance may be replaced at the City's bid price <br />if the abutting property owner elects to authorize work in addition to that in violation of <br />ordinances. If the property owner does not pay the invoice in full within ninety (90) days <br />of the issuance of the invoice, the authorization from the resident shall pernut the amount <br />to be made a lien upon the property to be collected in five annual installments. <br />SECTION 3: If the owner does not authorize the City to repair and replace said <br />sidewalks within thirty (30) days of receiving such notice, does not repair or replace said <br />sidewalk, or does not obtain an extension due to weather conditions, the owner may be <br />prosecuted for violation of Codified Ordinance Sec. 1363.07(a). <br />
