<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 99 - 63 <br />BY.• COUNCILMAN DEAN MCKAY <br />AN ORDINANCE CREATING NEW SECTION 911.20 OF <br />CHAPTER 911 OF THE CODIFIED ORDINANCES OF THE <br />CITY OF NORTH OLMSTED, ENTITLED "SEWERS <br />GENERALL Y, " IN ORDER TO PROVIDE FOR A METHOD <br />OF COLLECTING DELINQIIENT SEWER CHARGES, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the City Engineer has reported to this Council that the City has in the past <br />encountered substantial difficulties in the collection of sewer user charges incurred by property <br />owners during the period of time occurring between the date upon which said property owners <br />legally tap into the North Olmsted sanitary sewer system and the subsequent date upon which the <br />City of Cleveland Water Department begins to bill said property owners for sewer user charges; <br />and <br />WHEREAS, as a result, the City has lost in the past, and will continue to lose in the <br />future, significant revenues from such uncollected sewer user charges; and <br />WHEREAS, the City Engineer has recommended that this Council enact legislation <br />providing for the establishment of a tap-in deposit which the City may use as security for payment <br />of such sewer user charges which are not billed by the City of Cleveland Water Department and <br />which are difficult to otherwise collect; and <br />WHEREAS, this Council adopts the findings in the report of the City Engineer and desires <br />to enact legislation consistent with recommendation of the City Engineer; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That there be, and hereby is, enacted a new Section 911.20 of the Codified <br />Ordinances of the City of North Olmsted, Ohio, which shall read as follows: <br />"911.20 SEWER CONNECTIONS: TAP-IN DEPOSIT <br />The provisions of this section shall apply to all applicants for a tap-in permit to discharge to <br />the Municipal sanitary sewerage system and which are in that portion of the system for which <br />sewer user charges are based on water consumption as per Section 915.07. These provisions do <br />not apply to tap-in permits for an addition or change in use to a building already served by the <br />Municipal sanitary sewerage system. <br />
