GAREAU, JR. <br />A RESOL UTION EXTENDING FOR AN ADDITIONAL THREE MONTH PERIOD <br />THE MORATORIUMIMPOSED AGAINST ALL BUILDING AND CONSTRUCTION <br />ACTIVITY ON REAL PROPERTY WHICH IS LOCATED WITHIN THE HEREIN <br />DESCRIBED HISTORICAL DISTRICT OF THE CITY OF NORTH OLMSTED, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, pursuant to Resolution No. 98-129, this Council imposed a 90-day moratorium <br />against any further development within the therein described City's historical district in order to study <br />the district and propose legislation to encourage preservation of the historical structures located <br />within the district; and <br />WHEREAS, although the Council has acted diligently in studying the history of, the existing <br />structures within, and the future needs of the historical district, and, in addition, has reviewed model <br />historical preservation legislation prepared by the International Municipal Lawyers Association <br />(IMLA), as well as comparable legislation enacted by other Cuyahoga County communities, <br />additional time is nevertheless still needed to complete the Council's study and consider alternative <br />legislative responses; and <br />WHEREAS, the sole developer who had indicated a desire, at the time of the passage of <br />Resolution No. 98-129, to raze one of the historical structures in the historical district has, for <br />reasons other than the moratorium, elected not to consider redevelopment of the subject site at this <br />time; and <br />WHEREAS, there are pending at this time no other development proposals to raze any of <br />the historical structures located within the historical district, and therefore no prejudice will be <br />visited upon any property owner by extending the moratorium for an additional reasonable period <br />of time; and <br />WHEREAS, it is therefore the desire of this Council to extend the moratorium for an <br />additional 90-day period from February 9, 1999, to May 9, 1999, in order to enable Council to <br />complete its study of the district, consider legislative alternatives, and enact sensible legislation <br />to encourage the preservation of historical structures within the district; <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />
