? .. . <br />? <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2003 -176 <br />BY: Mayor Musial <br />AN ORDINANCE DISPENSING WITH THE RFP PROCESS OTHERWISE <br />REQIIIRED BY SECTIONS 111.03 ET SEQ. OF THE ADMINISTRATIVE <br />CODE AND A UTHORIZING THE MA YOR TD ENTER INTO A CONTRACT <br />WITH FLOYD BROWNE ASSOCIATES, I1VC ("FBA') FOR THE <br />PURPOSE OF PROVIDING CONSULTING ENGINEER SERVICES TO <br />THE CITY REGARDING THE CITY'S NPDES PERMIT FOR <br />WASTEWATER TREATMENT PLANT OPERATIONS, AND DECLARING <br />ANEMERGENCY <br />WHEREAS, pursuant to the authorization previously granted by this Council in 2002 and <br />2003, the Mayor entered into contracts with Floyd Browne Associates, Inc. ("FBA"), a <br />consulting engineer firm, to prepare sanitary sewer master plans for certain developing areas of <br />Olmsted Township (the Phase I and Phase II studies) that are presently served by, or are <br />proposed in the future to be served, by the North Olmsted Wastewater Treatment Plant; and <br />WHEREAS, FBA prepared the plans to the satisfaction of the City; and <br />WHEREAS, it is necessary for the City to seek additional consulting engineer services to <br />review the draft NPDES permit already submitted to Ohio EPA by the City and to provide <br />additional assistance, as needed, in order that the City may obtain a final NPDES permit from <br />Ohio EPA for the operations of the City's Wastewater Treatment Plant; and <br />WHEREAS, because of FBA's history and experience with the operations of the City's <br />Wastewater Treatrnent Plant, the Director of Public Service recommends that this Council <br />dispense with the RFP process otherwise required by Sections 111.03 et seq. of the <br />Administrative Code for the selection of a consulting engineer to provide the said professional <br />services; and <br />WHEREAS, FBA has proposed to provide said consulting engineer services in <br />accordance with its standard fee schedule and anticipates that, so long as the scope of the project <br />does not change, that the cost of said services will be approximately Ten Thousand Dollars <br />($10,000.00) or less; and <br />WHEREAS, the Director of Public Service has determined that the said proposal by FBA <br />is fair and reasonable to the City; and <br />WHEREAS, it is therefore the desire of this Council to dispense with the RFP process <br />otherwise required by 5ections 111.03 et seq. of the Administration Code for the selection of a <br />consulting engineer to provide the said professional services, because of FBA's history and <br />experience with the operations of the North Olmsted Wastewater Treatment Plant; and <br />WHEREAS, it is accordingly further the desire of this Council to authorize the Mayor to <br />enter into a contract with Floyd Brown Associates, Inc., on the basis of the proposal tendered <br />with the condition that total fees do not exceed Twenty-Five Thousand Dollars ($25,000.00); <br />
