? .. . ? CITY OF NORTH OLMSTED ORDINANCE NO. 2003 -176 BY: Mayor Musial AN ORDINANCE DISPENSING WITH THE RFP PROCESS OTHERWISE REQIIIRED BY SECTIONS 111.03 ET SEQ. OF THE ADMINISTRATIVE CODE AND A UTHORIZING THE MA YOR TD ENTER INTO A CONTRACT WITH FLOYD BROWNE ASSOCIATES, I1VC ("FBA') FOR THE PURPOSE OF PROVIDING CONSULTING ENGINEER SERVICES TO THE CITY REGARDING THE CITY'S NPDES PERMIT FOR WASTEWATER TREATMENT PLANT OPERATIONS, AND DECLARING ANEMERGENCY WHEREAS, pursuant to the authorization previously granted by this Council in 2002 and 2003, the Mayor entered into contracts with Floyd Browne Associates, Inc. ("FBA"), a consulting engineer firm, to prepare sanitary sewer master plans for certain developing areas of Olmsted Township (the Phase I and Phase II studies) that are presently served by, or are proposed in the future to be served, by the North Olmsted Wastewater Treatment Plant; and WHEREAS, FBA prepared the plans to the satisfaction of the City; and WHEREAS, it is necessary for the City to seek additional consulting engineer services to review the draft NPDES permit already submitted to Ohio EPA by the City and to provide additional assistance, as needed, in order that the City may obtain a final NPDES permit from Ohio EPA for the operations of the City's Wastewater Treatment Plant; and WHEREAS, because of FBA's history and experience with the operations of the City's Wastewater Treatrnent Plant, the Director of Public Service recommends that this Council dispense with the RFP process otherwise required by Sections 111.03 et seq. of the Administrative Code for the selection of a consulting engineer to provide the said professional services; and WHEREAS, FBA has proposed to provide said consulting engineer services in accordance with its standard fee schedule and anticipates that, so long as the scope of the project does not change, that the cost of said services will be approximately Ten Thousand Dollars ($10,000.00) or less; and WHEREAS, the Director of Public Service has determined that the said proposal by FBA is fair and reasonable to the City; and WHEREAS, it is therefore the desire of this Council to dispense with the RFP process otherwise required by 5ections 111.03 et seq. of the Administration Code for the selection of a consulting engineer to provide the said professional services, because of FBA's history and experience with the operations of the North Olmsted Wastewater Treatment Plant; and WHEREAS, it is accordingly further the desire of this Council to authorize the Mayor to enter into a contract with Floyd Brown Associates, Inc., on the basis of the proposal tendered with the condition that total fees do not exceed Twenty-Five Thousand Dollars ($25,000.00);
