?. , <br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2003 -166 <br />BY: Mayor Musial <br />A RESOLDTION TO APPROVE AND AUTHORIZE THE MAYOR TO <br />ENTER INTO A RELEASE AGREEMENT WITH STAR TRANSPORT, INC. <br />FOR DAMAGE DONE TO CITY PROPERTY AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, on June 10, 2003, William Walls, an employee of Star Transport, Inc. was <br />involved in a traffic accident, colliding with a traffic control signal, and damage was incurred to <br />City property in the amount of One Thousand Six Hundred Sixty ($1,660.00) Dollars; <br />WHEREAS, after replacement of the equipment and investigation of the incident, Star <br />Transport, Inc. proposes to pay the City of North Olmsted One Thousand Six Hundred Sixty <br />($1,660.00) Dollars to settle the claim. <br />NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the Mayor is hereby authorized to enter into a Release Agreement <br />with Star Transport, Inc. in the amount of One Thousand Six Hundred Sixty ($1,660.00) Dollars <br />in substantially the form as attached hereto as Exhibit A, as full and final settlement for damages <br />that occuned from an automobile accident on June 10, 2003. A copy of the Release Agreement <br />is attached hereto as Exhibit A and incorporated herein. <br />SECTION 2: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />reason that it is necessary that this Resolution go into effect immediately so that the City may <br />obtain a lump sum payment from Star Transport, Inc. for damages to City property, and further <br />provided it receives the affirmative vote of two-thirds of all members of Council, it shall take <br />effect and be in force immediately upon its passage and approval by the Mayor. <br />? <br />1 0 -21 <br />PASSED.?
