<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2003 - 133 <br />BY: MAYOR NORMAN T. MUSIAL <br />AN ORDINANCE AUTHORIZING THE MAYOR, UPON THE REVIEW AND <br />APPROVAL OF THE BOARD OF CONTROL, TO ENTER INTO A SOLE <br />SOURCE AND DIRECT PURCHASE AGREEMENT WITH WALKER <br />PROCESS EQUIPMENT FOR THE ACQUISITION OF A PRIMARY 5ETTLING <br />TANK 1COLLECTOR DRIVE ASSEMBLY SYSTEM FOR THE WASTEWATER <br />TREATMENT PLANT, WITHOUT PUBLIC BIDDING, AND DECLARING AN <br />EMERGENCY AS AMENDED. <br />WHEREAS, the Director of Public Service and the Superintendent of the <br />Wastewater Treatment Plant have enter into negotiations with Walker Process <br />Equipment, a Division of McNish Corporation, for the direct purchase of the Primary <br />Settling Tank/Collector Drive Assembly System, as a sole source thereof, to be used at <br />the Wastewater Treatment; and <br />WI-EREAS, the City has been quoted a price of $32,951.00 for the system, <br />completely assembled and delivered to the site within 4 to 6 weeks, in order to <br />accomplish the schedule for installation in November, 2003; and <br />WHEREAS, the Director of Public Service and the Superintendent of the <br />Wastewater Treatment Plant have evaluated the direct purchase proposal and have <br />determined that the quotation submitted is a fair, reasonable and competitive offer for the <br />direct purchase of the assembly system from Walker Equipment as the "sole source" of <br />the products necessary for the operation of the Wastewater Treatment Plant; and <br />WHEREAS, it is the desire of this Council, upon the advice and recommendation <br />of the aforesaid Director and Superintendent, to authorize the Mayor, upon the approval <br />of the Board of Control, to enter into a direct purchase agreement with Walker <br />Equipment, exempting the contract from competitive bidding as an emergency; and <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That this Council, upon the advise and recommendation of the <br />Director of Public Service and the Superintendent of the Wastewater Treatment Plant, <br />hereby finds and determines that the Walker Process Equipment quote is fair and <br />reasonable and, due to the emergency circumstances inherent in the direct purchase of <br />said equipment from this "sole source" supplier/contractor, further warrants an exception <br />from competitive bidding to enter this direct purchase agreement.
