<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2003 - 98 <br />BY: Mayor Musial. <br /> <br />AN ORDINANCE AMENDING SECTIONS 949.03 (CUTTING AND <br />TRIMMING REQUIRED), 949.04 (NOTICE; BIMONTHLY <br />INSPECTIONS; RIGHT TO APPEAL), AND 949.05 <br />(ENFORCEMENT BYSERVICE DIRECTOR; WORKBY CITI) OF <br />CHAPTER 949 OF THE STREETS, UTILITIES AND PUBLIC <br />SERVICES CODE ENTITLED "TREES AND WEEDS" IN ORDER <br />TO MORE EFFECTIVELY CONTROL THE GROWTH OF TALL <br />GRASS AND WEEDS ON IMPROVED AND UNIMPROVED LOTS <br />IN THE CITY OF NORTIf OLMSTED, AND DECLARING AN <br />EMERGENGY. <br />WHEREAS, in order to more effectively control the growth of tall grass and <br />weeds on improved and unimproved lots within the City of North Olmsted, the Mayor <br />has recommended to this Council that the nuisance height of grass and weeds be reduced <br />from eight inches to six inches, and the procedure for providing notice to offending <br />property owners be shortened from five days by registered mail to 48 hows written notice <br />by personal service; and <br />WHEREAS, this Council has reviewed the recommendations of the Mayor and <br />specifically finds that the growth of grass and weeds to heights above six inches on <br />improved and unimproved lots within the City of North Olmsted constitutes a nuisance <br />by contributing to the spread of vermin and disease, and also contributes to visual blight <br />and visual obstructions in the City; and <br />WHEREAS, this Council further finds that notice in the form of 48 hours written <br />notice by personal service to a property owner is as effective method of notice and as <br />protective of the due process rights of property owners as five days notice by registered <br />mail is; and <br />WHEREAS, it is accordingly the desire of this Council, based upon the <br />recommendations of the Mayor and its own legislative findings, to amend the appropriate <br />sections of Chapter 949 of the Streets, Utilities and Public Services Code in order to <br />prohibit the growth of weeds and grass in excess of six inches on improved and <br />unimproved lots in the City, and to further provide for 48-hour written notice by personal <br />service to property owners violating said prohibition to abate violations; <br />NQW THEItEFORE, BE IT QRDAINED BY THE COUNCIL OF THE <br />CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />
