em`k, <br />lkwe <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2003-93 <br />BY: Council Member Gareau <br />0- <br />IV', <br />? 4 // f l D7 <br />AN ORDINANCE AMENDING SECTIONS 721.04, 721.05, <br />721. 06, AND 721. 07 OF THE BUSINESS REGULATION CODE, <br />ENTITLED "TEMPORARY BUSINESS LICENSE; FEE AND <br />DURATION," "LOCATION OF TEMPORARY PLACE OF <br />BUSINESS," AND "DEPOSIT FOR CLEANING PREMISES," <br />IN ORDER TO FURTHER REGULATE THE OUTDOOR <br />STORAGE AND SALE OF GOODS FROM COMMERCIAL <br />PARKING AREAS, TO RESTRICT COMMERCIAL TENT AND <br />SIDEWALK SALES, AND DECLARING AN EMERGENCY, AS <br />AMENDED. <br />WHEREAS, this Council has received complaints regarding the scope and proliferation of <br />outdoor storage and sale of goods from within parking areas, tents and on the sidewalks of <br />commercial premises within the City; and <br />WHEREAS, this Council has observed the effects of said activities, such as the overcrowding <br />of sidewalks, interference with parking and traffic patterns, the accumulation of refuse and debris, a11 <br />of which may result in unsightly and/or unsafe conditions for motorists and pedestrians; and <br />WHEREAS, this Council finds that such activities, while having the potential to adversely <br />effect the health, safety and general welfare of the citizens of North Olmsted, also supply valuable <br />services to and generate economic enhancement for the citizens of North Olmsted; and <br />WHEREAS, this Council desires to further define, regulate and promote the temporary <br />business activity associated with parking lot, tent or sidewalk sales from commercial premises and <br />to prohibit deleterious practices or the creation of a nuisance; and <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That Section 721.04 of the Business Regulation Code which presently read <br />as follows: <br />721.04 TEMPORARY BUSINESS LICENSE; FEE AND DURATION. <br />(a) Each person, whether principal or agent, who proposes to conduct or engage in the sale <br />of goods, wares, merchandise, property, tangible or intangible, of any nature whatsoever, and <br />services, from a temporary place of business, within the City, shall, before opening same and <br />before offering sale of such goods, wares, merchandise, property and/or services procure a license <br />to do so from the Director of Public Safety, which application shall be made not less than ten days <br />prior to the time such activity is to take place. <br />(b) The applicant for a temporary business license shall furnish the Director of Public Safety <br />with the following information: <br />
