<br />CITY OF NORTH OLM5TED <br />ORDINANCE NO. 2003-92 <br />BY: Council Member Gareau <br />AN ORDINANCE AMENDING SECTIONS 1359. 01(d) AND 1359.99 <br />OF THE BUILDING CODE, ENTITLED RESPECTIVELY <br />"DEFINITIONS" AND "PENALTY,"AND FURTHER CREATING <br />NEW SECTIONS 1359.08 AND 1359.09 OF THE BUILDING CODE, <br />ENTITLED RESPECTIVELY "NnTIF4C,4TmN n?INFORMATION <br />TO BE PROVIDED REGARDING UNOCCUPIED COMMERCIAL <br />BIIILDING" AND "PROPERTY MAINTENANCE BOND, " IN <br />ORDER TO REGULATE UNOCCUPIED COMMERCIAL <br />BUILDINGS, TO ENABLE THE BUILDING COMMISSIONER TO <br />CAIISE THE ABATEMENT OF NUISANCES, AND DECI.ARING AN <br />EMERGEIVCY, AS AMENDED. <br />WHEREAS, this Council has received complaints regarding and has observed the <br />effects of untrimmed trees, grass, weeds and natural growth accumulating upon and <br />aFOUnd the premises of unoccugied cammercial buildings within the City; and <br />WHEREAS, this Council finds that such conditions may constitute a public <br />nuisance and may have an adverse effect upon the health, safety and welfare of the <br />citizens of North Olmsted; and <br />WHEREAS, this Council desires to further regulate unoccupied commercial <br />buildings so as to specifically define those conditions that most require maintenance, <br />especially in the area of landscaping, trees and grass; and <br />WffEREAS, this Council desires to further regulate unoccupied commercial <br />buildings so as to require nefifieatien-by property maintenance information from <br />property owners upon the termination of occupancy where violations of Chapter 1359 <br />have been noticed, and to require the posting and replenishment of a maintenance bond; <br />and <br />WHEREAS, this Council desires to further regulate unoccupied commercial <br />buildings so as to authorize the Building Commissioner to cause the abatement of such <br />nuisance conditions by initiating corrective actions including expenditure of maintenance <br />bond funds for immediate property maintenance. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NQRTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That Sections 1359.01(d) of the Building Code which presently <br />read as follows-. <br />
