CITY OF N(?RTH OLMSTED <br />ORDINANCE NO. 2003 - 86 <br />BY: MAYOR MUSIAL & COUNCILMAN GAREAU, JR. <br />AN ORDINANCE AMENDING SECTIONS 927. 04, 927 05, 927. 06, <br />927. 07, AND 927. OS OF THE STREETS, UTILITIES AND PUBLIC <br />SERVICES CODE, BEING VARIOiIS SECTIONS OF CHAPTER 927 <br />ENTITLED "STORM WATER MANAGEMENT AND URBAN <br />SEDIMENT POLLUTIONABATEMENI'SYSTEMS,"SO AS TO <br />FOLLOW RULES AND REGULATIONS PROMULGATED BY THE <br />UNITED STATES ENVIRONMENTAL PROTECTIONAGENCY <br />(EPA), AS AMENDED. <br />WHEREAS, upon the advise and recommendation of the City Engineer, with the <br />full support and consent of the Mayor, the amendments herein are necessary to update <br />local ordinances and thereby maintain compliance with rules and regulations imposed by <br />the U. S. EPA; and <br />WHEREAS, it is the intention of this Council to authorize and direct the City <br />Engineer to provide for local enforcement of storm water management standard <br />consistent with and as required by federal law; and <br />WHEREAS, it is the desire of this Council to accomplish the goals of the <br />eliminating water pollution, reducing stagnation in stormwater ditches, and to otherwise <br />encourage systems to clean-up water retention and flow; and <br />N'HEREAS, this Council finds that it is in the interest of the health, safety and <br />welfare of the City to amend various Sections of Chapter 927, to update local stormwater <br />management ordinances and thereby adopt, follow and enforce recent changes in the <br />rules and regulations of the U. S. EPA; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 927.04 of the Streets, Utilities and Public Services <br />Code, entitled "Stormwater Management and Erosion and Sediment Control Plan.," <br />which presently reads as follows: <br />"927.04 STORMWATER MANAGEMENT AND EROSION AND <br />SEDIMENT CONTROL PLAN. <br />(a) In order to control sediment pollution of the waters of the City of North <br />Olmsted or the State of Ohio, the owner or person responsible for the development area <br />
