<br />er:~ <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 72- /~ <br />AN ORDINANCE AUTHORIZING THE BUILDING <br />COMMISSIONER TO PROCEED WITH THE DEMO- <br />LTTION OR REMOVAL OF THE DWELLINGS ON <br />PERMANENT PARCEL NO. 235-11-16, LORAIN <br />ROAD, NORTH OLMSTED, ONTO. <br />WHEREAS, pursuant to the provisions of Ordinance No. 1331.01 - 1331.99 <br />of the Codified Ordinances of the City of North Olmsted, the Building Commissioner <br />has determined that the abandoned dwellings known as Permanent Parcel No. 235- <br />11-16 and located at 27845 Lorain Road, North Olmsted, Ohio, the record title holder <br />is Mr. Ray B. Simons, is unsafe, dangerous to human life and a hazard to the safety, <br />health and public welfare of the citizens of North Olmsted ;and <br />WHEREAS, notice to repair, remove and demolish said buildings was served <br />by certified mail on said record title holder on August 8, 1972, ordering said title <br />holder to repair, remove or demolish said dwellings and to commence such repair, <br />removal or demolition within forty-eight hours (48) of receipt of said notice ; <br />and <br />WHEREAS, said notice informed the record title holder of his right to appeal <br />the condemamtion order of the Bulding Commissioner within fifteen days (I5) ; <br />and <br />WHEREAS, said record title holder, Ray B. Simons, failed to file an appeal <br />within the fifteen (15) days and has failed to comply with the order of the Building <br />Commissioner. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North <br />Olmsted, State of Ohio <br />Section 1. That Council deems it necessary to proceed with the demolition <br />and removal of the dwellings or accessory buildings at 27845 Lorain Road, North <br />Olmsted, Ohio, also known as Permanent Parcel No. 235-11-16, owned by Ray B. <br />Simons, whose mailing address fs 20911 Avalon Drive, Rocky River, Ohio 44116, <br />by reason of the fact that said dwellings have been determined to be dangerous to <br />human life and a hazard to the public safety, health and welfare of the citizens of <br />the City of North Olmsted, and that the cost of said demolition and removal be paid <br />from the General Fund of the City of North Olmsted and charged to the owner as a <br />special assessment or lien on said parcel of land, and assessed and collected in <br />the manner or other assessments as provided by law. <br />Section 2. That the Clerk of Council be and she is hereby directed to <br />forward to Mr. Ray B. Simons at 20911 Avalon Drive, Rocky River, Ohfo 44116, <br />of this Ordinance. <br />Section ~. WHEREFORE, this Ordinance shall take effect and be in force <br />at the earliest date permitted by Article IV, Section 12 of the Charter of the City of <br />North Olmsted. <br />PASSED: ;. di <br />ATTEST: ~% <br />~~~ <br />Nora T.
