F <br />1 <br />`~ <br /> <br /> <br />CITY '~!~ Q <br />ORDINANCE N0.72-~ <br />AN ORDINANC£ AMENDING SECTION 533.07 OF THE <br />GENERAL OFFENSES CODE OF THE CITY OF NORTH <br />OLMSTED, OHIO, (CODIFIED ORDINANCES) EN- <br />TITLED "INHALING TO7~C VAPORS ;PENALTY " TO <br />CONFORM TO CHANGES ENACTED BY THE OHIO <br />GENERAL ASSEMBLY, AND DECLARING AN EMERGENCY. <br />WHEREAS, Council has determined that it is in the best interest of the <br />City of North Olmsted that the North Olmsted General Offenses Code be reviewed <br />to eliminate any conflicts with the provisions of the State Statutes, as enacted <br />by the Ohio General Assembly. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North <br />Olmsted, State of Ohio <br />Section 1. That Section 533.07, Chapter 533 (Codified Ordinances) of the <br />North Olmsted General Offenses reading as follows : <br />533.07 INHALING TOXIC VAPORS ;PENALTY. <br />(a) No person shall deliberately smell or inhale any drug or any <br />other noxious substances or chemical containing any ketones, <br />aldehydes, organic acetates, ether, chlorinated hydrocarbons <br />or any other substances containing solvents relea-sing toxic <br />vapors in such excessive quantitites as to cause conditions <br />of intoxication, inebriation, excitement, stupefaction or <br />dulling of the brain or nervous system. This section applies <br />with particularity to, but is not limited to, fgernail polish, <br />model airplane glue or any other substance or chemical which <br />has the aforementioned effect upon the brain or nervous system <br />when smelled or inhaled. <br />(b) Notwithstanding the general penalty provided in this chapter, <br />whoever violates subsection (a) hereof ~s~all be fined not less <br />than twenty-five dollars ($25.00) nor more than one hundred <br />dollars ($100.00) for the first offense, and not less than fifty <br />dollars ($50.00) nor more than two hundred dollars ($200.00 ) <br />and shall be imprisoned not more than six months, or both, such <br />fine and imprisonment, for each subsequent offense. <br />be and the same is hereby amended to read,as follows : <br />533.07 PURCHASE, USE OR POSSESSION OF HARMFUL INTOXICANT. <br />(a) Except for lawful resear,~h, clinical or medical purposes, no <br />person, with intent to induce intoxication or similar physi- <br />ological effects, shall purchase, possess, have under his <br />control, use or administer to another any harmful intoxicant. <br />(b) As used in this section, "harmful intoxicant "does not include <br />beer or intoxicating liquor, but means any compound, mixture, <br />preparation or substance the gas, fumes or vapor of which <br />
