<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 72-~~~ <br />BY: i <br />AN ORDINANCE REPEALING SECTION 529.04 OF THE <br />GENERAL OFFENSES CODE OF THE CITY OF NORTH <br />OLMSTED, OHIO , (CODIFIED ORDINANCES } EN- <br />TITLED, "UNLAWFUL PUJ~NISHMENT OR NEGLECT ", <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, Council has determined that it in the best interest of the City of <br />North Olmsted that the North Olmsted General Offenses Code be reviewed to eliminate <br />any conflict with the provisions of the State Statutes, as enacted by the Ohio General <br />Assembly ;and <br />WHEREAS, Section 529.04 of the North Olmsted General Offenses Code is <br />patterned after Ohio Revised Code 2903.08 ;and <br />WHEREAS, the 1972 State Legislature has amended Statute 2903.08, which <br />Statute is ~;~ampassed by the North Olmsted General Offenses Code, Chapter 533, <br />entitled, "Offenses Relating to Persons ", Section 533.01, entitled , "Abandonment, <br />Torture or Neglect of Child or Pregnant Woman "; and <br />WHEREAS, Council now wishes to repeal Section 529.04. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North <br />Olmsted, State of Ohio : <br />Section 1. That Section 529.04, Chapter 529 (Codified Ordinances) of the <br />North Olmsted General Offenses wading as follows : <br />5 29.04 UNLAWFUL PUNISHMENT OR NEGLECT. <br />No person having the control of or being the parent or guardian <br />of a child under the age of sixteen years shall willfully abandon <br />such child, or torture, torment, or cruelly or unlawfully push <br />him or willfully or negligently fail to furnish him necessary and <br />proper food, clothing or shelter. (ORC 2903.08 ) <br />be and the same is hereby repealed . <br />Section 2. That any ordinanee or parts of ordinances, or resolutions or parts <br />of resolutions ,inconsistent with the provisions of this Ordinances, are hereby <br />repealed with the effective date of this Ordinance. <br />Section 3. That this Ordinance is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, safety, <br />health and welfare by virtue of the fact that Section 529.04 prior to this amend- <br />ment is in conflict with the provisions of the State Statutes.
