• <br />CITY OF NORTH OLMSTED <br />.ORDINANCE NO. 72 ~~~ <br />BY: /~ <br />AN ORDINANCE ENACTING SECTION 525.07 OF THE <br />GENERAL OFFENSES CODE OF THE CITY OF NORTH <br />OLMSTED, OHIO, (CODIFIED ORDIATAI30E'S ) EN- <br />~~ <br />TITLED, OPEN CONTATN'ER PROHIBITED " TO CON- <br />FORM TO CHANGES ENACTED BY THE OHIO GENERAL <br />ASSEMBLY, AND DECLARING AN EMERGENCY. <br />WHEREAS, Council has determined that it is in the best interest of the <br />City of North Olmsted that the North Olmsted General Offenses Code be reviewed <br />to eliminate any conflicts with the provisions of the State Statutes, as enacted <br />by the Ohio General Assembly. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North <br />Olmsted, State of Ohio : <br />Section 1. That Section 525.07, Chapter 525 -. (Codified Ordinances) of the <br />North Olmsted General Offenses shall read as follows : <br />525.07 OPEN CONTAINER PROHIBITED. <br />No person shall have in his possession an opened container of <br />intoxicating liquor in a State liquor store, or on the premises of <br />the holder of any permit issued by the Department of Liquor Control, <br />or in any other public place. This section does not apply to in- <br />toxicating liquor which has been lawfully purchased for cornsumption <br />on the premises where bought of a holder of an A-1-A, A-2, D-2, <br />D-3, D-3a , D-4 D-5 or D-~a permit. (ORC 4301.62 } <br />Section 2. That any ordinance or parts of ordinances, or resolutions or parts <br />of resolutions, inconsistent with the provisions of this Ordinance, are hereby re- <br />pealed with the effects date of this Ordinance. <br />Section 3. That this Ordinance is hereby declared to be an emergency <br />measure necessary for the immediate; preservation of the public peace, safety, <br />health and welfare by virtue of the fact That Section 525.07 pr#~or to this amend- <br />ment is in conflict with the provisions of the State Statutes.
