<br />CTTY OF NORTH OLMSTED <br />ORDINANCE NO. 72- ~,,?D <br />BY: ~ ~•~~~ <br />AN ORDINANCE AMENDING THE TRAFFIC CODE OF <br />THE CITY OF NORTH OLMSTED, OHIO, CHAPTER <br />343 (CODIFIED ORDINANCES ), ENTITLED, "OPERATION <br />WITHOUT CONSENT ; STEALII~1'G PARTS ;TAMPERING " <br />TO CONFORM TO CHANGES ENACTED BY THE OHIO <br />GENERAL ASSEMBLY, AND DECLARING AN EMERGENCY. <br />WHEREAS, Council has deterred that it is in the best interest of the City <br />of North Olmsted that the North Olmsted Traffic Code be reviewed to eliminate any <br />conflicts with provisions of the State Statutes, as enacted by the Ohio General <br />Assembly . <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North <br />Olmsted, State of Ohio <br />Section 1. That Sections 343.01 to 343.05, inclusive, Chapter 343 (Codified <br />Ordinances) of the North Olmsted Traffic Code reading as follows : <br />343.01 OPERATION WITHOUT CONSENT OF OWNER. <br />(a) No person shall purposely take, drive, or operate any motor <br />vehicle without the consent of the owner. (ORC 4549.04 ) <br />(b) No person shall move a vehicle without the consent of the driver <br />or owner into any place or position which would make the driver <br />or owner liable to a penalty for a violation of this Traffic Code. <br />343.02 BREAKING AND ENTERING COMPARTMENT . <br />No person shall unlawfully break and enter, or attempt to unlaw- <br />fully break and enter, the locked compartment of any motor vehicle <br />or trailer. "Compartment " as used in this Section includes all <br />area of any motor vehicle or trailer wherein persons or property <br />are normally transported. (ORC 4549.041 ) <br />343.03 STEALING MOTOR VEHICLE PARTS. <br />No person shall maliciously or with, intent to steal or without <br />authority from the owner remove from any motor vehicle any <br />portion of the running or steering gear, pump, or any tire, rim, <br />cover, tube, clock, casing, radiator, fire extinguisher, tool, <br />lamp, starter, battery, coil, spring, gas or oil tank, bell or any <br />signal device, speedometer, license number, horn, box, basket, <br />trunk or carrier, shield, hood, oiler, gauage, grease cup, chain, <br />lock nut, bracket, valve, volt, rod, cap,screws, wire, spark <br />plug, carburetor, megneto, pipe, fan, belt, cylinder, switch, <br />brakes, electric bulbs, or any device, emblem, or monogram <br />thereon, any attachment, fastening, or other appurtenance, or <br />any part attached to the motor vehicle which is necessary in the <br />use, control, repair, or operation thereof. <br />No person shall knowingly buy, receive, or have in his possession <br />any of such unlawfully removed articles or any part thereof. <br />( ORC 4549.05 ) <br /> <br />
