WHEREAS, Council has determined that it is in the best interest of the City of North Olmsted that the North Olmsted Traffic Code be reviewed to eliminate any conflicts with provisions of the State Statutes, as enacted by the Ohio General Assembly. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North Olmsted, State of Ohio : Section 1. That Section 331.03, Chapter 331 (Codified Ordinances) of the North Olmsted Traffic Code reading as follows 331.03 OVERTAKING, PASSING TO LEFT ; DRIVER'S DUTIES. (a) The operator of a vehicle overtaking another proceeding in the same direction shall signal to the vehicle to be overtaken, shall pass to the left thereof at a safe distance, and shall not again drive to the right side of the roadway until safely clear of the overtaken vehicle . (b) Except when overtaking and passing on the right is permitted, the operator of an overtaken vehicle shall give way to the right in favor of the overtaking vehicle at the latter's audible signal, and he shall not increase the speed of his vehicle until completely passed by the overtaking vehicle. be and the same is hereby amended to read as follows: 331.03 OVERTAKING, PASSING TO LEFT ; DRIVER'S DUTIES. The following rules govern the overtaking and passing of vehicles proceeding in the same direction. (a) The operator of a vehicle overtaking another vehicle proceeding in the same direction shall, except as provided in subsection (c ) hereof, signal to the vehicle to be overtaken, shall pass to the left thereof at a safe distance, and shall not again drive to the right side of the roadway until safely clear of the overtaken vehicle. (b) Except when overtaking and passing on the right is permitted, the operator of an overtaken vehicle shall give way to the right in favor of the overtaking vehicle at the Tatter's audible signal, and he shall not increase the speed of his vehicle until completely passed by the overtaking vehicle. (c) The operator of a vehicle overtaking and passing another vehicle proceeding in the same direction on a divided street or highway as defined in Section 331.31 a limited access highway as defined in Ohfo R.
