AN ORDINANCE AMENDING THE TRAFFIC CODE OF THE CITY OF NORTH OLMSTED, OHIO, SECTION 303.03 (CODIFIED ORDINANCES ), ENTITLED, " ROAD WORKERS, MOTOR VEHICLES AND EQUIP- MENT EXCEPTED " TO CONFORM TO CHANGES ENACTED BY THE OHIO GENERAL ASSEMBLY, AND DECLARING ~N EMERGENCY. WHEREAS, Council has determined that it is in the best interest of the City of North Olmsted that the North Olmsted Traffic Code be reviewed to eliminate any conflicts with provisions of the State Statutes, as enacted by the Ohio General Assembly . NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North Olmsted, State of Ohio Section 1. That Section 303.03, Chapter 303 (Codified Ordinances of the 15Torth Olmsted Traffic Code reading as follows : 303.03 ROAD WORKERS ;ROADWORK MOTOR VEHICLES AND EQUIPMENT EXCEPTED. The provisions of this Code shall not apply to persons, teams, motor vehicles, and other equipment while actually eng~g~d in work upon the surface of the street or highway within an area designated by traffic contrei devices, but shall apply to such persons and vehicles when traveling to or from suci~ work. be and the same is hereby amended to read as follows : 303.03 ROAD WORKERS, MOTOR VEHICLES AND EQUIPMENT EXCEPTED. The provisions of this Traffic Code do not apply to persons, teams, motor vehicles and other equipment while actually engaged in work upon the surface of a street or highway within the area designated by traffic contreL:~ievices, but apply to such persons and vehicles when traveling to or from such work. The drivers of snow plows , traffic line stripers , road sweepers , mowing machines, tar distributing vehicles and other vehicles utilized in snow or ice removal or toad surface maintenance, while engaged in work upon a street or highway, provided such vehicles are equipped with flashing lights and such other markings as are required by law, and such lights are in operation when the vehicles are so engaged shall be exempt from criminal prosecution for violation of Sections 331.O1,to 331.04, inclusive, 331.06, 331.07, 331.31, 333.04 and 351.19. Such exemption shall not apply to such drivers when their vehicles are not so engaged. This section shall not exempt a driver of such equipment from civil liability arising from the violation of the sections referred to herein.
