:3 <br />-~ <br />~,. <br />BY: ~, <br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 71- /~6 <br />~,~~:' <br />A RESOLUTION AUTHORIZING THE DIRECTOR <br />OF LAW TO APPROVE A JOURNAL ENTRY TO <br />ENABLE THE "INTERIM "DISTRIBUTION OF <br />LOGAL GOVERNMENT FUNDS, AND DECLARING <br />AN EMERGENCY. <br />WHEREAS, certain litigation pending in the Franklin County Court of Appeals <br />has the effect of preventtrrg distribution of the 1971 Local Government Funds ;and <br />WHEREAS, it is necessary that we have so much of these funds as is possible <br />in order to meet the financial needs of our municipality ;and <br />WHEREAS, the Franklin County Court of Appeahs has indicated that if all or <br />substanitially all governmental units agree to a journal Entry, a distribution of <br />approximately Ninety percent (90%) of an amount equal to the " Iow "award by <br />either the County Budget Commission or the Board of Tax Appeals will be permitted ; <br />and <br />WHEREAS, the proposed journal Entry has provisions for repayment to the <br />event the advance to any subdivision is greater than the final determination of <br />the Court,. <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of North <br />Olmsted, State of Ohio : <br />Section 1. That the Director of Law be and he is hereby authorized to approve <br />and to execute in behalf of the City of North Olmsted a journal Entry, a copy of which <br />is attached hereto and made a part of this Resolution, authorizing an interim distribution <br />of Local Govenment Funds. <br />Section 2. That the Clerk of Council be and she is hereby authorized and directed <br />to transmit a certified copy of this Resolution, together with the signed journal Entry, <br />to the Cuyahoga County Mayors and City Managers Assocition for inclusion in a <br />master Journal Entry to be presented to the Franklin County Court of Appeals. <br />Section 3. This Resolution is declared to be an emergency measure immediately <br />necessary for the preservation of the public peace, health and safety of the City of <br />North Olmsted, such emergency existing by reason of the fact that it is #aemediately <br />necessary to provide for an interim distribution of Local Government Gunds in order <br />to obtain funds at the earliest time possible to promote the most efficient adminis- <br />tration of City government ;WHEREFORE, Council determines that an emergency <br />exists, that this resolution is an emergency measure and shall take effect and be <br />in force from and after the date of its passage and signature by the Mayor <br />PASSED: 4~;~'n~ ~'~ ~ ~ ,1971 <br />ATTEST: <br />~~ r%" ~~ <br />Nora T.
