"~ <br />BY• <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 70- I7 <br />AN ORDINANCE AUTHORIZING THE DIRECTOR <br />OF PUBLIC SERVICE TO CONTRACT FOR THE <br />REPAIR OF THE ALLIS-CHALMER FRONT END <br />LOADER USED AT THE SEWAGE TREATMENT <br />PLANT WITHOUT ADVERTISING FOR BIDS, <br />AND DECLARING ~N EMERGENCY. <br />WHEREAS, the City of North Olmsted uses the Allis-Chalmers front <br />end loader at the Sewage Treatment Plant and also ~t the North Olmsted land <br />fill area, as the front end loader is vital to the operation of the Sewage Treat- <br />ment Plant ;and <br />WHEREAS, said Allis-Chalmer front end loader has become inoperative <br />because of the need for extensive repairs estimated to cost approximately $4,100.00; <br />and <br />WHEREAS, the operation of the Sewage Treatment Plant is necessary to <br />avoid a dangerous health menace and no other equipment is available and the <br />hiring of substitute :equipment while bids could be taken would be impractical ; <br />and <br />WHEREAS, Council deems the situation to be an emergency requiring <br />unusual procedure to avoid a serious threat to the health of the inhabitants of <br />the City of North Olmsted. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of <br />North Olmsted, State of Ohio <br />Section 1. That the Director of Public Service be and he is hereby <br />authorized to enter into a contract for the repair of the City's Allis-Chalmer <br />front end loader, which is used at the Sewage Treatment Plant and the North <br />Olmsted land fill area, without the necessity of advertising for bids for such <br />repairs . <br />Section 2. That the Director of Finance be and he is hereby authorized <br />to pay the cost of the repairs to the Allis-Chalmers front end loader. <br />Section 3. That this Ordinance is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public pease, health and <br />safety by virtue of the fact that continued operation of the Sewage, Treatment Plant <br />is essential to the health of the City and its inhabitants. WHEREFORE, and pro- <br />viding this Ordinance receives a vote of two-thirds (2/3) of the members of Council, <br />this Ordinance shall take effect and be in force imrnedfately upon its passage, other- <br />wise, at the earliest period allowed by law. <br />PASSED• ~~~~ ~/~~ ,1970 <br />ATTEST: <br />~~..c-~- <br />Nora T.
