~ .,x .. r ~, ~~ CITY OF NORTH OLMSTED RESOLUTION NO. 70-/,~ A RESOLUTION AUTHORIZING THE DIRECTOR OF LAW TO APPROVE A JOURNAL ENTRY TO ENABLE THE "INTERIM "DISTRIBUTION OF LOCAL GOVERNMENT FUNDS, AND DECLARING AN EMERGENCY. WHEREAS, certain litigation pending in the Supreme Court of Ohio has the effect of preventing distribution of local government funds ;and WHEREAS, these funds are most necessary in the usual daily operation of our municipality ;and WHEREAS, the Supreme Court has indicated that if all the local govern- mental units agree to a Journal Entry in the form attached, a distribttion of ap- proximately 80% of an amount equal to the "low "award by either the County Budget Commission or the Board of Tax Appeals will be enabled ;and WHEREAS, the entry has provisions for repayment in the event the ad- vance is greater than the final determination of the Court. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of North Olmsted, State of Ohio Section 1. That the Director of Law be and he is hereby authorized to approve a Journal Entry in the form set forth in " Exhibit A "attached hereto, on behalf of the City of North Olmsted. Section 2. That the Director of Law be and he is hereby authorized to transmit a certified copy of this Resolution together with the signed Journal Entry to the Cuyahoga County Mayors andCity Managers Association for inclusion in a master Journal Entry to be presented to the Supreme Court of Ohio . Section 3. That this Resolution is an emergency measure in that the funds involved are essential to the current operation of this municipality.
