<br />CITY OF NORTH OIMSTED <br />Ohio: <br />BE IT ORDAIl~ by the Council of the City of Nos~th Olmsted, Cuyahoga County, <br />Section 1. That the revised assessment of the cost and expense of improving <br />Southern Avenue Fran McKenzie Road to a point 165 feet west of Decker Avenue by <br />constructing a 7-inch concrete pavement 25.5 feet wide with appurtenances, in- <br />clu~ling storm sewer inlets, and by ecnzstrueting concrete sidewa]ks, amounting in <br />the aggregate to $42,139.06, as reported to this Council on the 3rd day of Feb- <br />'Y, 1970, by the Engineer of this City and now on file in the office of the <br />Clerk of Council, be and the same is hereby adopted and confixmsd and that there <br />be and are hereby Levied and assessed upon the lots and ].ands bounding and abutting <br />upon said improvement the several amounts reported as aforesaid, which asses~ents <br />are in proportion to the special benefits and are not in excess of any statutory <br />limitation. <br />Section 2. That the assessment against each lot or parcel of land shall be <br />payable in cash within thirty days after the passage of this ordinance or at the <br />option of the owner in ten annual or twenty semi-annual instal],meats with interest <br />at the same rate as shall be borne by the bonds to be issued in anticipation of <br />the Collection Of the sam~e• A11 Cash petyments Shall be made to t$e Director of <br />Finance of this City. All assessments and instal]~ents thereof remeinixag unpaid <br />at the expiration of said thirty days sha11 be certified by the Clark of Council <br />to the County Auditor as provided by law to be placed by him on the tax duplicate <br />and collected as other takes are collected. <br />Section 3. That the Clerk of Council shall. cause a notice of the passage <br />of this ordinance to be published once in a newspapex of general circulation in <br />this City and to continue on file in her office said revised assessments. <br />Section ~+. The Clerk of Council is hereby directed to deliver a certified <br />copy of this ordinance to the County Auditor within twenty days after its passage. <br />Section 5. This ordinance is hereby declared to be an emergency measure <br />necessary for the inmaediate preservation of the public peace, health and safety <br />of said City and for the further reason that the immediate levy of such assess - <br />ments is necessary to permit the issuance of bonds to provide funds to refits <br />outstanding notes and thereby protect the credit of the City; wherefore, this <br />ordinance shall be in fu11 force and effect from and immediately after its passage <br />and approval by the Mayor. <br />Passed: ~7'" ~' 1 <br />Attest: <br />. /1~'~~.e~r <br />Nora T.
