<br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 73- ~~ <br />BY: ~%~~. ~i4z.~- <br />^~~ <br />A RESOLUTION AUTHORIZING THE MAYOR TO <br />ENTER INTO AN AGREEMENT WITH THE CUYAHOGA <br />COUNTY COMMISSIONERS ESTABLISHING RATES FOR <br />THE TREATMENT OF SEWAGE IN OLMSTED TOWNSHIP, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, the Cuyahoga Board of County Commissioners are charged with <br />the duty of protecting the health and welfare of residents of Olmsted Township and <br />are authorized to enter into contracts for the benefit of residents of Olmsted Town- <br />ship ; and <br />WHEREAS, newly enacted water quality guidelines for the drainage area of <br />the City and County areas required the City to construct improvements at the City's <br />waste water treatment facilities to provide higher degree of treatment and nutrient <br />removal ;and <br />WHEREAS, the cost of these improvements including the increased cost of <br />ope~tion and maintenance of these new facilities has been allocated to the various <br />entities being served by the City's treatment facilities and the allocation to the <br />County for the area being served requires that rates and charges be increased. <br />NOW, THEREFORE,BE IT RESOLVED by the Council of the City of North <br />Olmsted, State of Ohio : <br />Section 1. That the Council of the City of North Olmsted having been advised <br />of the terms of the First Supplemental contract between the City and the Cuyahoga <br />Board of C ommissioners for the famishing of sewer services to the residents of the <br />area of Olmsted Township as establisheai by map made a part of the origf~al contract, <br />and each member further being furnished a copy of said contract and having read same, <br />hereby approves said contract, for the furnishing of sewer services and authorizes <br />the Mayor t~f the City of North Olmsted to execute same on behalf of the Cfty the <br />contract and approve all the terms embodied therein. <br />Section 2. That this Resolution is hereby determined to be an ' emergency <br />measure necessary for the preservation of the public peace, safeth, health and <br />welfare, such emergency existing by vim of the immediate need to start and <br />continue sewer construction for health proposes.
