CITY OF NORTH OLNISTED <br />RESOLUTION N0. ? ? 4,5" <br />BY l ?? <br />A RESOLUTION DECLARING THE NECESSITY OF CONSTRUCTING <br />CERTAIN SIDEWALKS ON DECKER ROAD AND SOU3'H BARTON <br />ROA.D IN THE CITY OF NORTH OLMSTED, OHIO, REQ,UIRING <br />THAT ABUTTING PROPERTY OWNERS CONSTRUCT THE SAME, <br />AND DECLARING AN IIKERGENCY. <br />Ohio: <br />BE IT RESOLVED by the Council of the City of North Olmsted, Cuyahoga County, <br />Section 1; That it is necessary to construct concrete sidewa].ks in the <br />City of North Olmsted, Ohio, in accordance with the pl.ans, specifications and <br />estimates of cost therefor prepared by the City Engineer and now on file in <br />the office of the Clerk of Cauncil, and in the following locations; <br />l. Both sides of Decker Road from Midvale Avenue north:to Lorai.n Road, <br />east side 1530', west side 1075'. <br />2. Both sides of South Barton Roa.d from Lorain Roa.d southerly <br />2,716 feet. <br />Section 2: That the plans, specifications and estimate of cost for said <br />construction as heretofore filed be and the same are hereby approved. <br />Section 3: That the owners of all lots and lands bounding and abutting <br />upon the proposed sidewalks shall construct, in accordance with the plans and <br />specifications now on file, the portion of such sidewalks abutting on their res- <br />pective properties within a period of thirty days after service of notice of the <br />passage of this resolution; and, if such construction sha.ll not be completed <br />within such period of thirty days, then this Council shall have the same done <br />and the entire cost thereof shall be assessed upon the property of each default- <br />ing owner and made a lien thereon, to be collected in the manner provided by law, <br />with penalty and interest as provided by law. <br />Section 4; That the Clerk of this Council is directed to cause a written <br />notice of the passa,ge of this resolution to be served on each affected property <br />owner as required by law. <br />Section 5; Tha,t this resolution is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, health and <br />safety by virtue of the need for the immediate construction of such sidewalks to <br />permit safe passage by persons using said streets and to eli.minate existing <br />ha.zards to pedestrians; Wherefore, this resolution shall be in flzll force and ef- <br />fect frcan and immediately after its passage and approval by the Mayor. <br />PASSED ? 3?
