CITY OF NORTH OLMSTED <br />BY <br />RESOLUTION NO. 68- 1,31j <br />A RESOLUTION AUTHORIZING THE DIRECTOR OF <br />LAW TO APPROVE A jOURNAL ENTRY TO ENABLE <br />THE " INTERIM " DISTRIBUTION OF LOCAL <br />GOVERN MENT FUN DS, AN D DECLARIIVG AN <br />EMERGENCY. <br />WHEREAS, certain litigation pending in the Supreme Court of Ohio <br />has the effect of preventing distribution of local government funds ; and <br />WHEREAS, these funds are most necessary in the usual daily <br />operation of our municipality ; and <br />WHEREAS, the Supreme Court has indicated that if all the local <br />governmental units agree to a journal Entry in the form attached, a dis- <br />tribution of approximately 60% of an amount equal to the " low " award by <br />either the County Budget Commission or the Board of Tax. Appeals will be <br />enabled ; and <br />WHEREAS, the entry has provisions for repayment in the event the <br />advance is -greater than the final determination of this Court. <br />IVOW, TIEREFORE, BE IT RESOLVED by the Council of the City of <br />North Olmsted, State of Ohio : <br />Section 1: That the Director of Law be and he is hereby authorized <br />to approve a Journal Entry in the form set forth in Exhibit A attached hereto, <br />on behalf of the City of North Olmsted. <br />Section 2: That the Director of Law be and he is hereby authorized <br />to transmit a certified copy of this resolution together with the signed journal <br />Entry to the Local Government Committee of the Law Directors Assoctation <br />for inclusion in a master Journal Entry to be presented to the Supreme Court <br />of Ohio. <br />Section 3: That this Resolution is hereby declared to be an emergency <br />measure necessary for the preservation of the public peace, health, safety and <br />welfare of the City by virtue of the fact that this resolution shall go tnto <br />immediate effect.
