-0 <br />CITY OF NORTH OLMSTED <br />ORDTNANCE NO. ?j - <br />?, <br />BY <br />. ? <br />AN ORDINANCE LEVYING SPECIAL ASSESSMENTS FOR <br />THE CONSTRUCTTON OF SIDEWALKS ON ALEXAIVDER ROAD <br />AND RARTON ROAD, AND DECLARING AN EMERGENCY. <br />4 <br />8E IT ORDAINED by the Council of the City of North Olmsted, Cuya- <br />hoga County, Ohio: <br />Section l: That the assessment of the cost and expense of con- <br />structing sidewalks on both sides of Alexander Road from Clague Road to the <br />easterly corporation line and on the northeaste rly side of Barton Road from <br />Lorain Road to the westerly corporation line in accordance with Resolution <br />No. 66-109, amounting in the aggregate to $24,224.61, as reported to this <br />Cogncil on the 18th day of April, 1967 by the City Engineer, but with the <br />reduction of the assessment against Permanent Parcel No. 233-4-18 owned by <br />Floyd and B. Waters from $108.63 to $91.25, notice of the filing of which <br />assessments has been given as required by law, be and the sam is hereby <br />adopted and confirmed, and that there be and are hereby levied and assessed <br />upon the lots and lands bounding and abutting upon said improvement the <br />several amounts reported as aforesaid as changed anc orrected by Council, <br />which assessments and the description of said lots an,d lands are now on <br />file in the office of the Clerk of th is Council and which assessments are <br />not in excess of the special benefits or in excess of any statutory <br />limitation. <br />Section 2: That the assessment against each lot or pa,rcel of <br />land shall be pa.yable in cash within thirty days after the ga,ssage of this <br />ordinance or at the option of the owner in five annual installments with <br />interest at the same rate as shall be borne by the bonds to be issued in <br />anticipation of the collection of the same. All cash pa,yments shall be <br />made to the Director of Finance of this City. All assessments and install- <br />ments thereof remaining unpaid at the expiration of said thirty days shall <br />be certified by the Clerk of this Council to the County Auditor as provided <br />by law to be pla.ced by h3.m on the tax duplicate and collected as other taxes <br />are collected. <br />Seetion 3: That the Clerk of this Council shall certify a copy <br />of this ordinance to the County Auditor within twenty days after its <br />passage. <br />Section 4: This ordinance is hereby declared to be an emergency <br />measure necessary for the immediate preservat3on of the public peace, health <br />and safety of sa3d City, and for the further reason that the imnediate levy <br />of these assessments is necessary to permit bonds to be issued to fund the <br />outstanding note issued in anticipation of the bonds and thereby protect <br />the credit of the City; wherefore, this ordinance shall be in full fozce <br />and effect from and iminediately after its passage and approval by the Mayor. <br />PASSED : Qlt.w (e. )9(.,O8' _ <br />' <br />ATTEST : <br />k - <br />C-V <br />C1erk of Council President f Council <br />APPROVED : C:. •Z'? ? ? <br />Mayor <br />/ N <br />/ <br />? <br />? , <br />s-k <br />/?.S'
