CITY OF NORTH OLMSTED <br />RESOLUTI ON 110. 68- 71 <br />BY <br />A RESOLUTION OPPOSING THE APPLICATION FOR A <br />LIQUOR PERMIT WITHIN THE CITY OF NORTH OLMSTED <br />BY FRANK C, NARDI AND PHILLIP ENGOGLIA, AND <br />DECLARING AN EMERGENCY <br />WHEREAS, pursuant to Section 4303.261 of the Ohio Revised Code the <br />North Olmsted Legislative Authority was notified of application No. New 6306707- <br />0A)05 for a D-5 permit in the name of Frank C. Nardi and Phillip Engoglia , 24173 <br />Lorain Road, North Olmsted, Ohio; and <br />WHEREAS, Section 4303. 261 of the Ohio Revised Code provides for the <br />Legislative Authority L)O object to the issuance cf an application for a liquor <br />permit ivithin 30 days of the date of the notification of such application. <br />NOW, THEREFORE, BE IT RESOLUED by the Council of the City of North <br />Olmsted, State of Ohio : <br />Section l. That the Gouncil of the City of North Olmsted, Ohio does <br />hereby exercise its right to object to the issuance of a D-5 permit applied for <br />under application No. New 6306707-0005 by Frank C. Nardi and Phillip Engoglia, <br />24173 Lorain Road, North Olmsted, Ohio, and does direct the Clerk of Council to <br />sehd by cerified >mail: <br />1. 'I?vo certified copies of this Resolution of Objections; and <br />2. Two signed statements in writing, listing the reasons for <br />the ob3ections. <br />and prays that the Department of Liquor Control set a time and date for a <br />member of this Council to be heard on this rriatter. <br />Section 2. That this Resolution is hereby declared to be an emergency <br />measure necessary for the preservation of the public peace, health, safety and <br />welfare of the City by virtue of the fact that the Ohio Revised Code provides for <br />the Legislative Authority to object to the issuance of an application . WHEREFORE, <br />this Resolution shall take effect and be in force immediately upon its passage, <br />otherwise, at the earliest period allowed by lavv. <br />PASSED: ?
