CITY OF NORTH OLMSTED <br />ORDIIVANCE NO. 69-/pLI <br />BY 52X4. )V,&,ja -4 <br />AN ORDINANCE AMENDIIVG THE GEIVERAL OFFENSES CODE <br />OF THE CITY OF NORTH OLMSTED, OHIO, SECTION 509.99 (b) <br />( CODIFIED ORDINANCES ), ENTITLED " PENALTY, " TO CON- <br />FORM TO CHANGES ENACTED BY THE OHIO GEIVERAL ASSEMBLY, <br />AND DECLARDING AN EMERGENCY. <br />WHEREAS, Council has determined that it is in the best interest of <br />the City of North Olmsted that the North Olmsted General Offenses Code be <br />reviewed to eliminate any conflicts with provisions of the State Statutes, as <br />enacted by the Ohio General Assembly. <br />NOW, THEREFORE, BE IT ORDAINED by th e Council of the City of <br />North Olmsted, State of Ohio : <br />Section 1. That Section 509. 99 ( b), Chapter 509 ( Codified Ordinances ) <br />of the North Olmsted General Offenses Code reading as follows: <br />509.99 ( b ) PENALTY. <br />( b) " Whoever violated Sections 509.04 or 509.06 <br />shall be fined not more than five hundred dollars <br />($500.00 ) or imprisoned not more than six months, <br />or both. " <br />be ard the same is hereby amended to read as follows: <br />509.99 ( b ) PENALTY. <br />( b 1 Whoever violates any provisions of Section 509.04, <br />509.06, 509.065 or 509.066 shall be fined not more <br />than five hundred dollars ($500.00 ) or imprisoned <br />but not more than six months, or both. <br />Section 2. That any ordinance or parts of ordinances, or resolution or <br />parts of resolutions, inconsistent with the provisions of this Ordinance, are <br />hereby repealed with the effective date of this Ordinance. <br />Section 3. That this Ordinance is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, safety, <br />health and welfare by virtue of the fact that Section 509. 99 ( b) prior to this <br />amendment is in conflict with the provisions of the State Statutes.
