CITY OF NORTH OLMSTED ? <br />ORDTNANCE NO. 69-83 <br />BY EIAN <br />AN ORDINANCE EIVACTING SECTION 533.01 OF THE GENERAL <br />OFFENSES CODE OF THE CITY OF NORTH OLMSTED, OHIO, <br />( CODIFIED ORDINANCES ), ENTITLED " UNLAWFUL PUNISH- <br />MENT OR NEGLECT, " TO CONFORM TO CHANGES ENACTED BY <br />THE OHIO GENERAL ASSEMBLY, AND DECLARING AN EMERGENCY. <br />WHEREAS, Council has determined that it is in the best interest of <br />the City of North Olmsted that the North Olmsted General Offenses Code be re- <br />viewed to eliminate any conflicts with provisions of the State Statutes, as en- <br />acted by the Ohio General Assembly. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of <br />North Olmsted, State of Ohio : <br />Section 1. That Section 533.01, Chapter 533 ( Codified Ordinanc es ) <br />of the North Olmsted General Offenses Code shall read as follows: <br />533.01 ABANDOIVMENT, TORTURE OR NEGLECT OF <br />CHILD OR PREGNANT WOMAN. <br />No person having the control of or being the parent or <br />guardian of a child under the age of eighteen years or <br />physically or mentally handicapped child under the age <br />of twenty-one years, nor the husband of a pregnant wo- <br />man, shall willfully afandon such child or pregnant wo- <br />man, or torture, tarment or cruelly or unlawfully punish <br />such child or such pregnant woman, or willfully or negli- <br />gently fail to furnish such child or such pregnant woman <br />necessary and proper food, clothing or shelter. <br />Section 2. That any ordinance or resolutions, or parts of ordinances <br />or parts or resolutions, inconsistent with the provisions of this Ordinance, are <br />hereby repealed with the effective date of this Ordinance. <br />Section 3. That ihis Ordinance is hereby declared to be an emerqency <br />measure necessary for the imrr?ediate preservation of the public peace, safety, <br />health and welfare by virtue of the fact that Section 533.01 prior to this amend- <br />ment is in conflict with the provi?sions of the State Statutes.
