<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 69-96 <br />BY? . <br /> <br />AN ORDINAN'CE EIVACTING SECTION 533.09 OF <br />THE GENERAL OFFENSES CODE OF THE CITY OF <br />NORTH OLMSTED, OHIO, ( CODIFIED ORDINANCES ), <br />ENTITLED " PURCHASE, USE OR POSSESSION OF LSD, " <br />TO CONFORM TO CHANGES ENACTED BY THE OHIO <br />GENERAL ASSEMBLY, AND DECLARING AN €MERGENCY. <br />WHEREAS, Council has determined that it is in the best interest of <br />the City of North Olmsted that the North Olmsted General Offenses Code be <br />reviewed to eliminate any conflicts with provisions of the State Statutes, as <br />enacted by the Ohio General Assembly. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of <br />North Olmsted, State of Ohio: <br />Section'l. That Section 533.09, Chapter 533 ( Codified Ordinances ) <br />of the North Olmsted General Offenses shall read as follows: <br />533.09 PURCHASE, USE OR POSSESSION OF LSD. <br />( a) As used in this section " Hallucinogen " means <br />d-lysergic acid diethylamide, commonly known as <br />LSD, N-N- dimethyltryptamine, commonly known as <br />DMT, psilocygin, mescaline, peyote, bufotenin, <br />epena, parica, ayahuasc?i,yage, caapi, amanita <br />muscaria and any other compound, mixture, pre- <br />paration or substance which produces hallucinations <br />or illusions when introduced into the body. <br />(b 1 No person shall, with intent to produce hallucinations <br />or illusions, purchase, use, possess or have under <br />his control an hallucinogen. Possession or control of <br />any hallucinogen specifically named in subsection ( a) <br />hereof constitutes prima-facie evidence of a violation <br />of this section, except that this section does not apply <br />to the use, possession or control of any hallucinogen <br />by licensed manufacturers, wholesalers, pharmacists, <br />owners of pharmacies, physicians and other persons, <br />for research, clinical or medicinal purposes authorized <br />by Federal law or any rules or regulations adopted pur- <br />suant thereof. <br />( c) Whoever violates this section shall, for a first offense, <br />be guilty of a misdemeanor. <br />Section 2. That any ordinance or parts of ordinances, or resolution or <br />parts of resolutions, inconsistent with the provisions of this Ordinance, are here- <br />by repealed with the effective date of this Ordinance.
