ORDINANCE NO. 69-?? <br />BY <br />AN ORDINANCE ENACTING SECTION 509.066 OF THE <br />GENERAL OFFENSES CODE OF THE CITY OF_ NORTH <br />OLMSTED, OHIO,(CODIFIED ORDIIVANCES ), ENTITLED <br />" ASSAULT OF LAW EIVFORCEMENT OFFICER OR FIREMAN, " <br />TO CONFORM TO CHANGES ENACTED BY THE OHIO <br />GENERAL ASSEMBLY, AND DECLARING AN EMERGENCY. <br />WHEREAS, Council has determined that it is in the best interest of <br />the City of North Olmsted that the North Olmsted General Offenses Code be <br />reviewed to eliminate any conflicts with provisions of the State Statutes, as <br />enacted by the Ohio General Assembly. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of <br />North Olmsted, State of Ohio : <br />Section 1. That Section 509.066, Chapter 509 ( Codified Ordinances ) <br />of the North Olmsted General Offenses Code reading as follows : <br />509.066 ASSAULT OF LAW ENFORCEMENT OFFICER <br />OR FIREMAN. <br />No person shall knowlingly assault and strike or wound <br />a law enforcement officer or fireman in the lawful performance <br />of his offical duties. <br />Section 2. That any ordinance or parts of ordinances, or resolution <br />or parts of resolutions, inconsistent with the provisions of this Ordinance, <br />are hereby repealed with the effective date of this Ordinance. <br />Section 3. That this Ordinance is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, safety, <br />health and welfare by virtue of the fact that Section 509.066 prior to this <br />amendment r5 in conflict with the provisions of the State Statutes.
