ORDINANCE NO. 69-?? BY AN ORDINANCE ENACTING SECTION 509.066 OF THE GENERAL OFFENSES CODE OF THE CITY OF_ NORTH OLMSTED, OHIO,(CODIFIED ORDIIVANCES ), ENTITLED " ASSAULT OF LAW EIVFORCEMENT OFFICER OR FIREMAN, " TO CONFORM TO CHANGES ENACTED BY THE OHIO GENERAL ASSEMBLY, AND DECLARING AN EMERGENCY. WHEREAS, Council has determined that it is in the best interest of the City of North Olmsted that the North Olmsted General Offenses Code be reviewed to eliminate any conflicts with provisions of the State Statutes, as enacted by the Ohio General Assembly. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North Olmsted, State of Ohio : Section 1. That Section 509.066, Chapter 509 ( Codified Ordinances ) of the North Olmsted General Offenses Code reading as follows : 509.066 ASSAULT OF LAW ENFORCEMENT OFFICER OR FIREMAN. No person shall knowlingly assault and strike or wound a law enforcement officer or fireman in the lawful performance of his offical duties. Section 2. That any ordinance or parts of ordinances, or resolution or parts of resolutions, inconsistent with the provisions of this Ordinance, are hereby repealed with the effective date of this Ordinance. Section 3. That this Ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, safety, health and welfare by virtue of the fact that Section 509.066 prior to this amendment r5 in conflict with the provisions of the State Statutes. WHERE- FORE, this Ordinance shall take effect and be in force immediately upon its passage, otherwise, at the earliest period allowed by law. PASSED: ? j ?
