, <br />?• <br />BY: . <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 81-31 <br />-oft <br />IC? b I <br />41 6f <br />' <br />AN ORDINANCE PROVIDING FOR THE SUBMISSION <br />TO THE ELECTQRS OF THE CITY OF NORTH OLMSTED <br />A PROPOSED AMENDMENT TQ THE CHARTER OF THE <br />CITY OF NORTH OLMSTED RELATING TO THE APPOINT- <br />MENT RATHF.R THAN THE ELECTION OF A DZRECTOR <br />OF LAW, AND DECLARING AN EMERGENCY. <br />WHEREAS, pursuant to the Charter of the City of North Olmsted, <br />and the Constitution of the State o£ Ohio, this Counci.l has determined <br />to authorize and direct the submission to the electors of the City <br />of North Olmsted of aproposed Ch_arter amendment, hereinafter set <br />forth at the Primary Election to be held on June 2, 1981, which <br />election is not less tfian sixty (60) days nor more than one hundred <br />twenty (120) days from tfie date of the passage of this Ordinance. <br />NOW, THEREFORE, BE IT ORDAINF.D BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY QF CUYAHOGA, AND STATE OF OHIO, TWO-THIRDS OF <br />COUNCIL CONCURRING: <br />SECTION l: That this Council hereby authorizes and directs <br />the submission to the electors of the City of North Olmsted at the <br />Primary Election to be held at the usual places of voting in said <br />City on Tuesday, June 2, 1981, the following proposal to amend the <br />Charter of the City of North Olmsted: <br />Proposal: That Article V, Section 2 of the Ch_arter be amended <br />to provi e or the appointment of the Director of Law by the Mayor <br />rather than having said positian be an elected position. Such amended <br />Section 2 of Article V to read as follows: <br />ARTICLE V <br />ADMINISTRATIVE OFFICERS AND DEPARTMENTS <br />SEC. 2 DIRECTOR OF LAW. <br />The Directox of <br />with Article III, Sect <br />director shall also be <br />The Directox of Law at <br />authoxized to practice <br />in the active practice <br />five years immediately <br />Law shall &,e appointed by the Mayor in accordance <br />ion 5 of this Chartex. As legal counsel and <br />attorney, he/she shall represent the City in all proceedings in court <br />or before any administrative body and in such other matters and con- <br />troversies as he/she is, by resolution or ordinance, directed to <br />prosecute. He/she or an Assistant Director of Law shall act as <br />Prosecuting Attorney for the City. He/she shall per£orm all other <br />duties now or hereinafter imposed upon city solicitors by the laws <br />of the State of Ohio unless otherwise provided by ordinance of the <br />Council and shall perform such duties as Council and the Mayor may <br />impose upon him/her consistent with the office.
