CITY OF NORTH OLMSTED <br />RESOLUTION N0. 89 - 74 <br />BY : /~~ ~.t/ ~ C~ <br />A RESOLUTION APPROVING AN ALTERNATIVE METHOD OF <br />APPORTIONING THE LOCAL GOVERNMENT REVENUE ASSISTANCE <br />FUND OF CUYAHOGA COUNTY FOR THE CALENDAR YEAR 1989 <br />AND THEREAFTER, AND DECLARING AN EMERGENCY. <br />WHEREAS, the Cuyahoga County Budget Commission has been analyzing <br />the method of apportionment of the Local Government Revenue Assistance Fund of <br />the County provided in Ohio Revised Code 5747.61; and <br />WHEREAS, the Cuyahoga County Budget Commission, the Board of County <br />Commissioners, the Boards of Township Trustees, and the legislative authorities <br />of municipal corporations within the County are desirous of implementing an <br />alternative method of apportioning the Local Government Revenue Assistance Fund <br />for the year 1989 and thereafter, in order to equitably distribute the Local <br />Government Revenue Assistance Fund, and <br />WHEREAS, an alternative method of apportionment, as set forth in <br />Exhibit "A" attached and as authorized by Ohio Revised Code 5747.63, has been <br />proposed for the consideration of this body. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, CUYAHOGA COUNTY AND STATE OF OHIO: <br />SECTION 1: That this Board hereby finds and determines that the <br />alternative method of apportionment of Local Government Revenue Assistance Funds <br />set forth in Exhibit "A", is objective and equitable and will exclude the limita- <br />tions of the present statutory formula established by.Chapter 5747.61 of the Ohio <br />Revised Code; and, pursuant to 5747.63 of the Ohio Revised Code, this body hereby <br />adopts and approves the alternative method of apportionment as set forth in <br />Exhibit "A", and the provisions thereof are incorporated herein and made a part <br />hereof by reference. <br />SECTION 2: That the adoption and approval of the alternate method <br />of apportionment set forth in Exhibit "A" shall be operative for funds to be <br />distributed in the year 1989 and thereafter. Such alternate method of apportion- <br />ment shall remain in full force and effect for each calendar year until revised, <br />amended or repealed in the same manner that it has been adopted or approved. In <br />the event such alternate method of apportionment is repealed, this body authorizes <br />the Local Government Revenue Assistance Fund of the County to be apportioned, <br />commencing in the calendar year following repeal, under the apportionment method <br />provided in 5747.62 of the Ohio Revised Code, unless a new method for apportion- <br />ment of such fund is provided in the action of repeal. <br />SECTION 3: That the Clerk of Council is hereby directed to certify <br />a copy of this Resolution to the Cuyahoga County Budget Commission. <br />
