CITY OF NORTH OLMSTED <br />ORDINANCE N0.89- 25 <br />B Y: MAYOR PETRIGAC <br />AN ORDINANCE AUTHORIZING THE SALE OF FOUR (4) <br />BUSES OWNED BY THE CITY OF NORTH OLMSTED, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the Council and Administration have determined <br />that the buses set forth on Schedule A, owned by the City of <br />North Olmsted and used to provide coordinated county wide <br />transit service, and <br />WHEREAS, the Greater Cleveland Regional Transit Authority <br />has replaced these vehicles with four (4) new buses funded. by <br />federal and county taxes. <br />WHEREAS, it is the desire of this Council to sell these <br />surplus buses in accordance with administrative recommendation <br />and the applicable legal requirements. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the following four (4) buses being used <br />for mass transportation purposes are no longer needed, to wit: <br />See attached Schedule "A" made a part <br />hereof as though fully rewritten herein. <br />SECTION 2: That the Service Director be and he is <br />authorized to sell said buses in accordance with the law, <br />provided however, that the bid is approved by the Board of <br />Control and further provided that the bidder, shall, upon <br />acceptance of the bid, pay to the Director of Finance of the <br />City of North Olmsted, five percent (5%) of the bid price and <br />that within five (S) days thereafter, the entire bid price shall <br />be paid and the successful bidder shall accept and remove said <br />property from the premises of the City. <br />SECTION 3: That this Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the preservation of <br />the public health, safety and welfare and for the further reason <br />that the sale of surplus equipment is necessary to protect the <br />value thereof for resale purposes, and to accept delivery of the <br />above said replacement buses to provide county wide transit <br />service, and further provided it receives the affirmative vote <br />of two-thirds of all members elected to Council, it shall take <br />effect and be in force immediately upon its passage and approval <br />by the Mayor. <br />
