Dean McKay <br />? <br />? <br />AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF NORTH <br />OLMSTED TO ENTER INTO AN AGREEMENT WITH THE BOARD OF <br />CUYAHOGA COUNTY COMMISSIONERS WHEREIN THE CITY OF NORTH <br />OLMSTED IS TO SERVE AS LEAD AGENCY IN AN APPLICATION FOR <br />A GRANT TO ASSIST IN THE DESIGN AND COPJSTRUCTION OF <br />SANITARY SEWER SYSTEM IMPROVEMENTS AND REHABILITATION <br />RECOMMENDED IN THE FACILITY PLAN STEP 1 SEWER SYSTEM <br />EVAULATION SURVEY (SSES) REPORT AND TO CONSTRUCT IMPROVE- <br />MENTS TO THE NORTH OLMSTED WASTEWATER TREATMENT PLANT AS <br />DESIGNED ACCORDING TO THE FACILITY PLAN STEP 2 AND TO <br />PERFORM OTHER NECESSARY MATTERS FOR A STEP 3 FEDERAL <br />GRANT UNDER THE PROVISIONS OF THE CLEAN WATER ACT <br />AMENDMENTS OF 1977, IN CONNECTION WITH IMPROVEMENTS AND <br />ADDITIONS TO THE WASTEWATER TREATMENT AND SANITARY <br />SEWERAGE FACILITIES OF OLMSTED TOWNSHIP, AS PART OF THE <br />AREA KNOWN AS THE NORTH OLMSTED FACILITY PLAN AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the City of North Olmsted has completed a Step 1 Facility Plan, <br />Sewer System Evaluation Survey, and the Step 2 design of improvements to the <br />North Olmsted Wastewater Treatment Plant for wastewater collection and <br />treatment in the North Olmsted Facility Planning Area, and <br />WHEREAS, sections of unincorporated areas in Olmsted Township, Cuyahoga <br />County are tributary to and served by the municipal sewer systems in the City <br />of North Olmsted, and <br />WHEREAS, the City of North Olmsted desires a sharing of costs for the <br />construction of improvements to the North Olmsted Wastewater Treatment Plant. <br />WHEREAS, the City of North Olmsted and the Board of County Corrnnissioners <br />desire to improve the sanitary sewer collection system in the City of North <br />Olmsted and in Olmsted Township as recorrmended in the Sewer System Evaluation <br />Survey report, and <br />WHEREAS, the United States Environmental Protection Agency requires an <br />agreement between the City of North Olmsted and the Board of County Commissioners <br />for Olmsted Township incorporating a user rate methodology and sewer use <br />regulations. <br />NOW, THEREFORE, BE IT ORDAINED BY TNE COUNCIL OF THE CITY OF NORTH OLMSTED, <br />COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby directed to enter into an <br />agreement with the Board of County Commissioners to share in the local costs for <br />the design and construction of improvements to the sanitary sewer system and the <br />North Olmsted Wastewater Treatment Plant, the construction of improvements to the <br />North Olmsted Wastewater Treatment Plants,a sanitary sewer user charge methodology <br />and sewer use regulations. <br />SECTION 2: That this ordinance is hereby declared to be an emergency measure <br />necessary for the preservation of the public health, safety and welfare, and for <br />the further reason that it is irrrnediately necessary in order to expedite the <br />filing of the application for federal grants, and further provided it receives the <br />affirmative vote of two-thirds of all members elected to Council, it shall take <br />effect and be in force immediately upon its passage and approval by the Mayor. <br />PASSED: ;? / J p?3 <br />ATTEST: <br />Florence E.
