<br />AN ORDINANCE AUTHORIZING THE BUILDING COMMISSIONER
<br />TO PROCEED WITH THE DEMOLITION OR REMOVAL OF THE
<br />SINGLE FAMILY DWELLING AND DETACHED GARAGE LOCATED
<br />ON PERMANENT PARCEL N0. 234-6-3, AT 30790 LORAIN ROAD,
<br />IN THE CITY OF NORTH OLMSTED, AND DECLARING AN EMERGENCY.
<br />WHEREAS, pursuant to the provisions of Codified Ordinance Nos.
<br />1331.01 to 1331.99 of the City of North Olmsted, the Building Commissioner
<br />has determined that the single family dwelling and detached garage that
<br />have been fire damaged, located on Permanent Parcel No. 234-6-3, at
<br />30790 Lorain Road, in the City of North !Jlmsted, are unsafe, dangerous
<br />to human life and hazardous to the safety, health and public welfare of
<br />the citizens of the City of North Olmsted, and
<br />WHEREAS, notice to repair, remove, or demolish said single
<br />family dwelling and detached ;arage was given by registered mail on
<br />March 3, 1983, ordering said title holder to repair, remove, or demolish
<br />said buildings, and to commence such repair, removal or demolition within
<br />sixty (60) days of receiving said notice, and
<br />WHEREAS, said record title holder, Stanley Yee, failed to reverse
<br />the Buildina Commissioner's order, and also failed to further appeal the
<br />decision o£ the Board of Building Code Appeals to higher tribunal of
<br />competent jurisdiction, and at this time has failed to comply with the
<br />order of the Building Commissioner.
<br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
<br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO:
<br />SECTION 1: That Council deems it necessary to proceed with
<br />the demolition and removal of the unsafe single family dwelling and
<br />detached garage, which have been fire damaged, located at 30790 Lorain
<br />Road, North Olmsted, Ohio, and further known as Permanent Parcel No.
<br />234-6-3, owned by Stanley Yee, by reason of the fact that said single
<br />family dwelling and detached ,arage have been determined to be dangerous
<br />to human li£e and a hazard to the public safety, health, and welfare of
<br />the citizens of the City of North Olmsted, and that the cost of said
<br />demolition and the removal be paid from the General Fund of the City of
<br />North Olmsted and charged to the owner(s) as a special assessment or lien
<br />on such parcel of land and assessed and collected in the manner of other
<br />assessments as provided by law.
<br />SECTION 2: That the Clerk of Council be and she is hereby
<br />directed to orward a copy of this Ordinance to Stanley Yee, 30790 Lorain
<br />Road, North Olmsted, Ohio, 44070.
<br />SECTION 3: That this Ordinance is hereby declared to be an
<br />emergency measure immediately necessary for the preservation of the
<br />nublic health, safety, and welfare, and for the further reason that
<br />the dilapidated condition of said single family dwelling and detached
<br />garage is a serious hazard to the health, safety, and welfare of the
