. t <br />CITY OF (dORTH OLMSTED <br />ORDINANCE N0. 84 - 11 <br />B Y : ??W_Ay <br />01- <br />AN ORDINANCE SUPERCEDING AND REPEALING ORDINANCE NUMBERS <br />74-166 (1-21-75), 75-195 (9-16-75), 77-31 (3-1-77), AND <br />77-64 (5-3-77) <br />ENTITLED <br />AN ORDINANCE TO PROVIDE FOR PROPER GRADING OF LAND TO <br />PROVIDE FOR THE DRAINAGE OF SURFACE WATER WITHIN THE CITY <br />Of NORTH OLMSTED BY PROVIDING FOR THE FURTHER REGULATION <br />AND INSPECTION OF THE INSTALLATION OF PRIVATE STORM WATER <br />DRAINAGE SYSTEMS, AS A`?_FNDFD. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, APJD STATE OF OHIO: <br />SECTION 1: Definitions. <br />That, for the purpose of this ordinance, the following terms, <br />phrases, words, and their derivatives shall have the meanina aiven in <br />this section: <br />a. "Natural Grade" is the elevation of the undisturbed surface <br />of the ground before the start of construction. <br />b. "Finished Grade" is the new final elevation of the ground <br />surface. <br />c. "Established Grade" is the finished grade as shown on an <br />improvement plan or grading plan approved by the City Engineer. <br />d. "City Engineer" wherever used shall mean the Engineer employed <br />by the City of North Olmsted and under the supervision of the <br />Director of Public Service. <br />SECTION 2: Developer's Duty to Grade within a Subdivision. <br />The Developer shall submit to the City, at the same time as <br />presenting the improvement plans, a grading plan of the area to be <br />developed. The Developer shall do the grading in accordance with the <br />.plans approved by the City and shall not deviate from that plan except <br />upon the written permission from the City Engineer, after the City?Engineer <br />has obtained approval of the changes from the Council of the City of North <br />Olmsted. Upon completion of the work, and with the approval of the City <br />Engineer for all changes, the Developer will furnish the City with <br />"As-Built" plans of the improvement. <br />SECTION 3: Builder's Duty to Grade within a Subdivision. <br />Building permits will not be issued for an individual building or <br />to individual builders until the builder has deposited $500.00 for each <br />lot. <br />a. That this deposit shall be used for the establishing of <br />finished ground grades, the checking of all, grades to see <br />if they conform to the approved plans, and if necessary, <br />to grade the site in accordance with the approved grading <br />plan. Costs shall be calculated at a rate of $30.00 per <br />hour for the time spent by the City Engineer, $30.00 per <br />hour for the Assistant City Engineer and $20.00 per hour <br />per man for the field crew for inspection.
