<br /> <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 84-39 <br />BY : AI <br />AN ORDINANCE AUTHORIZING THE SALE OF SURPLUS <br />PERSONAL PROPERTY OWNED BY THE CITY OF NORTH <br />OLMSTED AND PREVIOUSLY USED BY THE DEPARTMENT <br />OF PUBLIC SERVICES, AND DECLARING AN EMERGENCY. <br />WHEREAS, the Council and the Administration have determined <br />that various items of personal property owned by the City of North <br />Olmsted and formerly used by the Department of Public Services are <br />no longer needed for municipal purposes, and <br />WHEREAS, it is the desire of this Council to sell said personal <br />property in accordance with law. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That the following personal property was formerly <br />used by the Department of Public Services and is no longer needed <br />for municipal business, to wit: <br />See attached Schedule "A" made a part <br />hereof as though fully rewritten herein. <br />SECTION 2: That the Mayor be and he is hereby authorized to <br />sell said personal broperty to the highest bidder according to law, <br />provided however, that the highest bid is approved by the Board of <br />Control and further provided that the highest bidder shall, upon <br />acceptance of the bid, pay to the Director of Finance of the City of <br />North Olmsted, twenty-five percent (25q) of the bid price and that <br />within five (5) days thereafter, the entire bid price shall be paid <br />and the successful bidder shall accept and remove said property from <br />the premises of the City. The Mayor, havine; been advised upon receipt <br />of the full bid price, shall, if necessary, execute any and all <br />documents required by law. <br />SECTION 3: That this Ordinance is hereby declared to be an <br />emergenc,y, measure irnmediately necessary for the preservation of the <br />public health, safety and welfare and for the further reason that the <br />sale of surplus equipment is necessary to nrotect the value thereof <br />for resale purposes. <br />PASSED : <br />, <br />ATTEST: <br />Flo, <br />F ORENCE E.
