CITY OF NORTH OLMSTED <br />ORDINANCE N0. 84-52 <br />BY: Mr. 0'Grady <br />AN ORDINANCE ADOPTING A NEW SECTION 525.021 OF <br />THE CODIFIED ORllINANCES ENTITLEll "MIS- <br />IDENTIFICATION" OF CHAPTER 525 ENTITLED "LAW <br />ENFORCEMENT AND PUBLIC OFFICE". <br />WHEREAS, it has come to the attention of this Council <br />through the Prosecutor of the City, as well as the Police <br />Department, that on a number of occasions law enforcement <br />investigation has been hampered by individuals who are under <br />detention misindentifying themselves; and <br />WHEREAS, it is the desire of this Council to amend the <br />Codified Ordinances of the City of North Olmsted to include a new <br />Section dealing with the misindentification of individuals. <br />NOW, THEREFORE, BE IT ORDAINEB BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That there is hereby established a new Section <br />of the Codified Ordinances of the City of North Olmsted known as <br />525.021 "Misindentification" of Chapter 525 entitled "Law <br />Enforcement and Public Office" which new Section shall read as <br />follows: <br />525.021 MISIDENTIFICATION <br />(a) No persun who is under arrest for or under <br />investigation for any criminal, traffic or Juvenile offense <br />shall knowingly misidentify himself or represent himself to <br />be another person, whether real or fictional, to a public <br />official. <br />(b) Whoever violates this Section is guilty of <br />misidentification, a misdeameanor of the Second llegree. <br />SECTION 2: That any Ordinance or parts of Ordinances <br />inconsistent herewith are hereby repealed. <br />SECTION 3: That this Ordinance shall take effect and be in <br />force from and after the earliest period allowed by law and the <br />Charter of this City. <br />PASSED: <br />ATTEST: <br />FLORENCE CAMPBELL, ERK OF j'` AMES D.
