WILAMOSKY <br />AN ORDINANCE VACATING A PORTION OF A SANITAKY <br />SEWER EASEMENT LOCATED ON PROPERTY OCCUPIED BY <br />ST. CLARENCE CHURCH AND FUTHER ACCEPTING AN <br />EASEMENT FROM THE CATHOLIC DIOCESE OF <br />CLEVELAND AND OR ST. CLARENCE CHURCH FOR A <br />RELOCATED SANITARY SEWER AND DECLARING AN <br />EMERGENCY <br />WHEREAS, in order to expand their present church facility <br />St. Clarence requires the area where the existing sanitary sewer <br />is located; and <br />WHEREAS, the church is willing to relocate said sewer at its <br />sole cost and expense and at the same time to grant a new easement <br />wherein the relocated sewer is to be located; and <br />WHEREAS, the relocation project has been conceptually <br />approved by the Engineering Department. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That a portion of the Sanitary Sewer Easement <br />located on the property occupied by St. Clarence Church, which is <br />more fully described in a document filed with the Engineering <br />Department be and the same is hereby vacated and further that the <br />City hereby accepts an easement from St. Clarence Church and/or <br />the Catholic Diocese of Cleveland for a new Sanitary Sewer <br />Easement which is more fully set out in a proposed easement on <br />filed with the Engineering Department. <br />SECTION 2: That the granting of a new easement, relocating <br />of a new Sanitary Sewer line and the vacating of the former <br />easement shall be accomplished at the sole cost and expense of <br />St. Clarence Church and/or the Catholic Diocese of Cleveland, <br />SECTION 3: That the City Engineer is hereby directed to <br />cause a easement vacation and a new easement, consistent with <br />this Ordinance, filed with the County Recorder. <br />SECTION 4: That this Ordinance is hereby determined to be <br />an emergency measure necessary for the immediate preservation of <br />the public peace, property, health and safety of the of the City <br />and for the further reason that it is immediately necessary to <br />meet construction deadlines during the 1984 season and further <br />provided it receives the affirmative vote of two-thirds (2/3) of <br />all members elected to Council. It shall take effect and be in <br />force immediately upon its passage and approval by the Mayor.
