? <br />40*., lowft? <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 84-96 <br />BY: Mr. Bierman <br />AN ORDINANCE REQUIRING ANY PERSON CONVICTED OF <br />AN OFFENSE, OTHER THAN A MINOR MISDEAMEANOR <br />AND CONFINED TO PRISON, STATION HOUSE, <br />WORKHOUSE OR COUNTY JAIL TO REIMBURSE THE <br />CITY OF NORTH OLMSTED FOR ITS EXPENSES <br />INCURRED BY REASON OF CONFINEMENT AND <br />AUTHORIZING THE LAW DEPARTMENT TO INSTITUTE AN <br />APPROPRIATE CIVIL ACTION TO RECOVER SAME, AND <br />DECLARING AN EMERGENCY, <br />WHEREAS, the Ohio General Assembly has enacted Am. Sub. H.B. <br />363 into law; and <br />WHEREAS, said House Bill shall become effective September <br />26, 1984; and <br />WHEREAS, said House Bill authorizes the Council, of a <br />Municipal Corporation, to require any person who was convicted of <br />an offense other than a minor misdemeanor to reimburse the City <br />for the expenses incurred by the Municipal Corporation by reason <br />of such confinement, including but not limited to expenses <br />relating to the provision of food, clothing and shelter; and <br />WHEREAS, reimbursement may, pursuant to the provisions of <br />Am. Sub. H.B. 363, be required if confinement is in a workhouse, <br />prison, station house or county jail; and <br />NOtid, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUTNY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That any person convicted of any offense other <br />than a minor misdeameanor and who is thereafter confined to a <br />workhouse, prison, station house or county jail shall reimburse <br />to the City of North Olmsted its expenses incurred by reason of <br />said confinement, including but not limited to, the provision of <br />food, clothing, and shelter. The amount of reimbursement shall <br />be determined by a court of competent jurisdiction in an amount <br />and manner provided by law. <br />SECTION 2: That the Law Department is hereby authorized and <br />directed to institute an appropriate civil action in the name of <br />the City in a Court of competent jurisdiction to recover from the <br />convict reimbursement for the expenses of confinement in a <br />workhouse, prison, station house or county jail, as may be <br />determined by the Court in accordance with law. <br />SECTION 3: That all amounts recovered for reimbursement of <br />expenses of confinement shall be paid into the General Fund of <br />the City. <br />SECTION 4: That this Ordinance is hereby declared to be an <br />emergency measure necessary for the immediate preservation of <br />public peace, health, safety and welfare, and for the further <br />reason that it provides for the daily operation of a municipal <br />department, and provided it receives the affirmative vote of two- <br />thirds of all members elected to Council, it shall take effect <br />immediately upon its passage and approval by the Mayor.
