BY: MAYOR SWIETYNIOWFe" <br />? v • <br /> <br />NAME OF STREET: Clague Road <br /> <br />ORDINANCE N0. 85 - 49 <br />ROUTE NO.: CR-52 DATE_ iXo, 7/ 9,P S <br />An emergency ordinance enacted by the City of North Olmsted, Cuyahoga <br />County, Ohio, in the matter of the hereinafter described improvement and to request <br />cooperation by the County of Cuyahoga and the Department of Transportation, State of <br />Ohio. <br />WHEREAS, this Road improvement project within the corporation limits of the <br />MUNICIPALITY is part of a larger COUNTY project which is the interim resurfacing of <br />Clague Road from Mastick Road to Westwood Road in the Cities of North Olmsted and <br />Westlake. <br />WHEREAS, the MUNICIPALITY has recognized the need for and proposes the <br />improvement of a portion of public highway which is described as follows: <br />Interim resurfacing of Clague Road from Mastick Road to the North Olmsted North <br />Corporation Line. <br />N06J THEREFORE, be it ordained by the council of the City of North Olmsted, <br />County of Cuyahoga and State of Ohio; <br />A. CONSENT <br />1. That it is declared to be in the public interest that the consent of said <br />MUNICIPALITY be and such consent is hereby given to the COUNTY and the Ohio <br />Department of Transportation to construct the above described improvement <br />in accordance with plans, specifications and estimates approved by the <br />COUNTY. <br />B. COOPERATION <br />1. That the MUNICIPALITY will cooperate with the COUNTY and the Ohio <br />Department of Transportation in the interim resurfacing of Clague Road from <br />Mastick Road to the North Olmsted North Corporation Line. <br />2. That the COUNTY will prepare plans and specifications for the improvement <br />under current Cuyahoga County Engineer standards for construction of County <br />roads and bridges. <br />3. That the COUNTY will arrange for the supervision and administration of the <br />construction contract. <br />C. FUNDING <br />1. That the MUNICIPALITY hereby agrees to participate with the COUNTY in the <br />cost of the improvement by an allocation from the County Motor Vehicle <br />$5.00 License Tax Fund to pay the COUNTY portion of the project, <br />2. That if the project is financed as a Federal-aid Highway project, eligible <br />costs of the improvement shall be financed from the aforesaid funds. <br />3. That the MUNICIPALITY shall contribute forty percent (40%) of the costs of <br />construction, construction supervision, right-of-way and incidentals. <br />4. That the cost of plan preparation previously incurred by the MUNICIPALITY <br />for the section of Clague Road from Lorain Road to the North Olmsted North <br />Corporation Line will be credited toward the MUNICIPALITY`S share of the <br />cost of construction, construction supervision, right-of-way and <br />incidentals. The CQUNTY reserves the right to approve for credit any and <br />all costs associated with the previous preparation of plans and <br />specifications for the section of Clague Road from Lorain Road to the North <br />Olmsted North Corporation Line, in accordance with current COUNTY policies. <br />5. That the MUNICIPALITY agrees to deposit with the Treasurer of Cuyahoga
