10 <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 86-75 <br />BY: MAYOR PETRIGAC <br />AN ORDINANCE AUTHORIZING THE DIRECTOR OF LAW OF THE CITY <br />OF NORTH OLMSTED TO SETTLE THE CASE OF THE CITY OF NORTH <br />OLMSTELD VS. TUDOR INSURANCE COMPANY, COURT OF COMMON <br />PLEAS, CUYAHOGA COUNTY, CASE N0. 103430, AND DECLARING <br />AN EMERGENCY. <br />WHEREAS, the City of North Olmsted found it necessary to file suit <br />against Tudor Insurance Company because that insurance company failed to <br />defend the City in the lawsuit of Ronald Zurawski vs. The City of North <br />Olmsted which was filed in Federal Court, Northern District of Ohio; and <br />WHEREAS, the Law Department of the City, because of the failure of the <br />insurance company to defend said case, took up the defense and prevailed; <br />and <br />WHEREAS, the Tudor Insurance Company has offered the City of North <br />Olmsted the sum of One Thousand Three Hundred Dollars ($1,300.00) to settle <br />said case; and <br />WHEREAS, a great deal of the time and energy expended bp the Law <br />Department also included the cost for Law Clerks research time; and <br />WHEREAS, it is the desire of the Law Department to have the aforesaid <br />One Thousand Three Hundred Dollars ($1,300.00) reappropriated back in to <br />the line item for Law Clerk within the Law Department. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That this Council does hereby authorize and direct the <br />Director of Law for the City of North Olmsted to settle the lawsuit of the <br />City of North Olmsted vs. Tudor Insurance Company for the sum of One <br />Thousand Three Hundred Dollars ($1,300.00). <br />SECTION 2: That the Director of Finance is hereby authorized and <br />directed to accept the check of One Thousand Three Hundred Dollars <br />($1,300.00) from Tudor Insurance Company and is further directed to <br />reappropriate said amount into the line item for Law Clerk. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency
