t <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 86- 60 <br />BY: Janet Saringer <br />AN ORDINANCE ADOPTING A NEW AND REVISED SECTION 549.01 <br />AND ENACTING A NEW SECTION 549.12 OF THE CODIFIED <br />ORDINANCES RELATIVE TO POSSESSION AND USE OF "STUN <br />GUNS", AND DECLARING AN EMERGENCY <br />WHEREAS, an electronic device known as a"Stun Gun" has recently been <br />introduced, and is available for purchase, in the marketplace; and <br />WHEREAS, this Council believes that possession and use of said devices, <br />unless reasonably regulated through legislation, may result in acts <br />detrimental and injurious to the person and/or property of the residents of <br />this City and to the public at large. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That there is hereby adopted a new and revised Section <br />549.01 entitled "Definitions" of Chapter 549 entitled "Weapons and <br />Explosives" which shall read as follows: <br />549.01 DEFINITIONS <br />As used in this chapter: <br />(a) "Deadly weapon" means any instrument, device or thing capable of <br />inflicting death, and designed or specially adopted for use as a <br />weapon, or possessed, carried or used as a weapon. <br />(b) "Firearm" means any deadly weapon capable of expelling or <br />propelling one or more projectibles by the action of an explosive or <br />combustible propellant. "Firearm" includes an unloaded firearm, and <br />any firearm which is inoperable but which can readily be rendered <br />operable.
