ORDINANCE 87 - 112 <br />BY: ~v,v~ <br />AN ORDINANCE AUTHORIZING THE SALE OF SURPLUS <br />PERSONAL PROPERTY OWNED BY THE CITY OF <br />NORTH OLMSTED AND PREVIOUSLY USED BY THE <br />DEPARTMENT OF PUBLIC SERVICE, THE SAFETY <br />DEPARTMENT, AND THE RECREATION COMPLEX, AND <br />DECLARING AN EMERGENCY, AS AMENDED. <br />WHEREAS, the Council and the Administration have determined that <br />various items of Personal Property owned by the City of North Olmsted <br />and formerly used by the Department of Public Service, the Safety <br />Department, and the Recreation Complex are no longer needed for <br />municipal purposes, and <br />WHEREAS, it is the desire of this Council to sell said Personal <br />Property in accordance with Law. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the following Personal Property was formerly used <br />by the Department of Public Service , the Safety Department, or the <br />Recreation Complex, and is no longer needed for municipal business, to <br />wit: <br />See attached Schedule "A" made a part hereof <br />as though fully rewritten herein. <br />SECTION 2: That the Mayor be and she is hereby authorized to sell <br />said Personal Property to the highest bidder according to Law, provided <br />however, that the highest bid is approved by the Board of Control and <br />further provided that the highest bidder shall, upon acceptance of the <br />bid, pay to the Director of Finance of the City of North Olmsted, <br />twenty-five. percent (25%) of the bid price and that within five (5) <br />days thereafter, the entire bid price shall be paid and the successful <br />bidder shall accept and remove said property from the premises of the <br />City. The Mayor, having been advised upon receipt of the full bid <br />price, shall, if necessary, execute any and all documents required by <br />Law. <br />SECTION 3: That this Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />Public Health, Safety and Welfare and for the further reason that the <br />Sale of Surplus Equipment is necessary to protect the value thereof for <br />resale purposes. <br />
