(10 AN ORDINANCE ADOPTING A NEW AND REVISED CHAPTER 1331 OF THE CODIFIED ORDINANCES ENTITLED "DANGEROUS OR UNSAFE BUILDINGS", AND DECLARING AN EMERGENCY WHEREAS, the Council of the City of North Olmsted previously adopted standards and procedures regarding the City's repair, vacation and demolition of unsafe buildings, which were promulgated in Ordinance 68-200 (passed 2-4-69), and WHEREAS, Ordinance 68-200 was written to reflect the requirements of the Ohio Revised Code in effect at that time, and WHEREAS, the Ohio Revised Code now recognizes additional categories of parties in interest, not heretofore recognized, who are entitled to notice from the City of its intent to remove or repair insecure, unsafe or structurally defective buildings or other structures. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION l: That there is hereby established a new and revised Chapter 1331 entitled "Dangerous or Unsafe Buildings" which new and revised Chapter shall read as follows: 1331.01 DANGEROUS BUILDING DEFINED. All buildings or structures which have any or all of the following defects shall be deemed dangerous buildings: (a) Those whose interior walls or other vertical structural members list, lean or buckle to such an extent that a plumb line passing through the center of gravity falls outside of the middle third of its base. (b) Those which, exclusive of the foundation, show thirty-three percent or more of damage or deterioration of the supporting member or members, or fifty percent of damage or deterioration on the nonsupporting enclosing or outside walls or covering. (c) Those which have improperly distributed loads upon the floors or roofs or in which the same are overloaded, or which have insufficient strength to be reasonably safe for the purpose used.
