(10 <br />AN ORDINANCE ADOPTING A NEW AND REVISED CHAPTER 1331 <br />OF THE CODIFIED ORDINANCES ENTITLED "DANGEROUS OR <br />UNSAFE BUILDINGS", AND DECLARING AN EMERGENCY <br />WHEREAS, the Council of the City of North Olmsted previously adopted <br />standards and procedures regarding the City's repair, vacation and <br />demolition of unsafe buildings, which were promulgated in Ordinance 68-200 <br />(passed 2-4-69), and <br />WHEREAS, Ordinance 68-200 was written to reflect the requirements of <br />the Ohio Revised Code in effect at that time, and <br />WHEREAS, the Ohio Revised Code now recognizes additional categories of <br />parties in interest, not heretofore recognized, who are entitled to notice <br />from the City of its intent to remove or repair insecure, unsafe or <br />structurally defective buildings or other structures. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That there is hereby established a new and revised Chapter <br />1331 entitled "Dangerous or Unsafe Buildings" which new and revised Chapter <br />shall read as follows: <br />1331.01 DANGEROUS BUILDING DEFINED. <br />All buildings or structures which have any or all of the following <br />defects shall be deemed dangerous buildings: <br />(a) Those whose interior walls or other vertical structural members <br />list, lean or buckle to such an extent that a plumb line passing <br />through the center of gravity falls outside of the middle third <br />of its base. <br />(b) Those which, exclusive of the foundation, show thirty-three <br />percent or more of damage or deterioration of the supporting <br />member or members, or fifty percent of damage or deterioration on <br />the nonsupporting enclosing or outside walls or covering. <br />(c) Those which have improperly distributed loads upon the floors or <br />roofs or in which the same are overloaded, or which have <br />insufficient strength to be reasonably safe for the purpose used.
