<br /> <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 91-99 <br />BY: MR. MCKAY ON BEHALF OF MAYOR BOYLE AND THE ENTIRE COUNC IL <br />ORDINANCE RATIFYING AND CONFIRMING THE <br />ENTERING INTO OF AN EMERGENCY CONTRACT FOR <br />THE HAULING OF SLUDGE FROM THE SEWAGE <br />TREATMENT PLANT WITH BROWNING FERRIS <br />INDUSTRIES, AND DECLARING AN EMERGENCY. <br />WHEREAS, the City of North Olmsted has heretofore disposed of the sludge from the <br />sewage treatment plant with the use of its own personnel and equipment; and <br />WHEREAS, the City personnel recently has been advised by the Medina County <br />Sheriff's Department that the City trucks hauling the sludge to P.P.G. Landfill in Barberton, <br />Ohio, were overloaded per axle weight; and <br />WHEREAS, the Service Department being advised of the problem which would <br />necessitate a reduction in loads has determined that it would be cost prohibitive to haul smaller <br />amounts; and <br />WHEREAS, the City of North Olmsted currently has a contract with Browning Ferns <br />Industries to haul our refuse, and, as a result of that association, has agreed to haul the City <br />sludge and dispose of same at a cost similar or equal to the cost being charged by virtue of the <br />existing contract; and <br />WHEREAS, the Service Director, upon being advised of the aforesaid problem <br />immediately contacted Browning Ferris Industries for purposes of hauling City sludge; and <br />WHEREAS, it is the desire of this Council to authorize the Mayor to enter into an <br />agreement with Browning Ferns Industries to haul the sludge from our sewage treatment plant <br />without public bid. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That this Council does hereby ratify and confirm the actions of the <br />Director of Service with respect to the emergency removal of sludge from the sewage treatment <br />plant by the hiring of the services of Browning Ferris Industries and, further authorizes the <br />Mayor to enter into an agreement for the future removal of sludge from the sewage treatment <br />
