CITY OF NORTH OIMSTID <br />ORDINANCE N0. 91- 97 <br />BY'~ Mayor Ed Boyle <br />AN ORDINANCE DECLARING CITY OWNED REAL ESTATE LOCATED ADJACENT TO <br />4542 SILVERDALE ROAD, BEARING PERMANENT PARCEL NUMBER 232-27-16, <br />AS SURPLUS PROPERTY AND DIRECTING THE MAYOR TO SELL SAID SURPLUS PROPERTY. <br />WHEREAS, this Council has determined that the property adjacent to <br />4542 Silverdale Road, previously acquired in conjunction with the installation <br />of a storm sewer, is no longer needed for municipal purposes; and <br />WHEREAS, it is the desire of this Council to sell said property. <br />NOW, THEREFORE, BE IT ORDAINID BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the following described real estate belonging to the City <br />of North Olmsted is not needed for municipal purposes, to wit: <br />Situated in the City of North Olmsted, County of Cuyahoga, and State <br />of Ohio, and known as being part of Original Lot No. 16, and also <br />known as being the North part of Sublot No. 36 in S. H. Kleinman's <br />Westwood Allotment as shown in Volume No. 53 of Maps, Page 22, of <br />Cuyahoga County Records; said northerly part of Sublot No. 36 has <br />a frontage of 21.40 Feet on the westerly line of Silverdale Road and <br />extends back 151.26 Feet on the northerly line and 150 Feet (Recorded) <br />and 150.29 Feet (Calculated) on the southerly line, be the same more <br />or less, but subject to all legal highways. <br />SECTION 2: That the Mayor be and he is hereby authorized to sell said real <br />estate to the adjoining property owners; and in which said real estate may be <br />be split, and in which the northerly half of said parcel may be sold to the owner <br />of 4542 Silverdale Road, and the southerly half may be sold to the owner of <br />4558 Silverdale Road, each for a payment of One Dollar ($1.00). Furthermore, <br />said purchasers shall be responsible for the preparation of a plat of such lot <br />split and consolidation, and the recording of same. <br />SECTION 3: That the sale of said real estate shall be contingent upon the <br />City reserving a storm sewer easement on each half of the entire parcel. <br />
