CITY OF NORTH OLMSTED <br />ORDINANCE NO. 91-49 <br />BY MAYOR EDWARD BOYLE <br />AN ORDINANCE ESTABLISHING NEW CHAPTER 955 OF <br />THE CODIFIED ORDINANCES OF THE CITY OF NORTH <br />OLMSTED, ENTITLED "SALE OF SURPLUS CITY PERSON- <br />AL PROPERTY. " <br />WHEREAS, Article IV, Section 13(d) of the Charter of the City of North Olmsted <br />provides that Council may make provisions by ordinance for the sale or disposal of municipal <br />property; and <br />WHEREAS, this Council wishes to establish a procedure for the sale of surplus city <br />personal property which will be cost efficient and which will assure that such property is sold <br />for the highest reasonable price; and <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That there be and hereby is created new Chapter 955 of the Codified <br />Ordinances of the City of North Olmsted, entitled, "Sale of Surplus City Personal Property" <br />which in its entirety shall read as follows: <br />"CHAPTER 955 <br />SALE OF SURPLUS CITY PERSONAL PROPERTY <br />955.01 Definitions. <br />(a) "Director" shall refer to, with respect to the sale of surplus <br />property operated by, under the control of, or maintained by the <br />Department of Public Safety, or any division thereunder, the <br />Director of Public Safety; otherwise, the term shall refer to the <br />Director of Public Services. <br />(b) "Surplus property" shall mean any personal property owned <br />by the City which is not being used by the City and for which the <br />City has no reasonable contemplated future use. <br />955.02 Procedure for Sale. <br />(a) Upon determining that an item of surplus property should be <br />sold, the Director shall determine, using available valuation <br />resources, including, for example, blue or red books, the fair <br />market value of the item of property. If the Director determines <br />that the item of property has a fair market value of $1,000.00 or <br />less, then the Director may solicit offers to purchase the property <br />employing any commercially reasonable method for soliciting <br />
